RESOLUTION NO. 98-26
AUTHORIZING THE VACATION OF
A PERMANENT EASEMENT FOR STREET AND UTILITY PURPOSES
IN OUTLOT A, PLYMOUTH FREEWAY CENTER 4TH ADDITION
WIffiREAS, a petition was received to vacate a certain portion of a permanent easement for street and
utility purposes, in Outlot A, Plymouth Freeway Center 4"' Addition; and
WI-IEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WI-IEREAS, a public hearing with respect to said vacation was scheduled for January 7, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WI-IEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of January 7, 1998; and
WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WIffiREAS, the Council did hold a public hearing on January 7, 1998 to inform any and all interested
parties relevant to the vacation of a certain portion of a permanent easement for street and utility
purposes, in Outlot A, Plymouth Freeway Center 4"' Addition; and
WI-IEREAS, it was determined by the City Council that said easements were not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following portion of a permanent easement for street and
utility purposes, in Outlot A, Plymouth Freeway Center 4"' Addition be vacated:
A permanent easement for street and utility purposes over, under, across and through that
portion of the above described parcel contained within a strip of land 60.00 feet in width, 30.00
feet on either side of the below described line:
Commencing at the intersection of the center line of Empire Lane and the south line of
Plymouth Freeway Center 2" a Addition; thence northerly along said center line of a
distance of 530.00 feet; thence northeasterly 69.22 feet along a tangential curve, concave
to the southeast having a radius of 237.06 feet and a central angle of 16 degrees 43
minutes 49 seconds to the point of beginning of said center line; thence continue
northeasterly 120.04 feet along last described curve, having a central angle of 29 degrees
00 minutes 50 seconds; thence northeasterly 210.07 feet along a reverse curve, concave
to the northwest, having a radius of 263.51 feet and a central angle of 45 degrees 40
minutes 37 seconds; thence northerly tangent to the last described curve, 584.61 feet to
the northerly line of said Outlot A.
