HomeMy WebLinkAboutCity Council Resolution 1998-007CITY OF PLYMOUTH RESOLUTION 98-7 APPROVING A PRELIMINARY PLAT FOR UNITED PROPERTIES FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF FERNBROOK LANE AND 34TH AVENUE (97160) WHEREAS, United Properties has requested approval of a Preliminary Plat to create two lots for Plymouth Woods Office Center, for the 15.32 -acre site located at the southeast corner of Fernbrook Lane and 34"' Avenue; and WHEREAS, the property is presently legally described as Outlot A, Plymouth Freeway Center 4"' Addition; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of United Properties for a Preliminary Plat to create two lots for Plymouth Woods Office Center, subject to the following conditions: 1. The approved Preliminary Plat shall be in compliance with the plans received by the City on November 21, 1997, except as amended by this resolution. 2. A maintenance agreement is required between the Developer and the City for the water quality pond. 3. Cross -easements for access, driveways, parking, and utilities between proposed Lots 1 and 2 shall be filed with the Final Plat. Resolution 98-7 (97160) Page 2 of 3 4. A drainage easement for ponding purposes shall be placed over the water quality pond to the 100 -year high water elevation. 5. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES permit, as well as approval of the Bassett Creek Watershed District. 6. A deceleration lane is required for the Fernbrook Lane curb cut. 7. A plan and profile sheet is required for the deceleration lane and the Empire Lane cul-de-sac. 8. Plan and profile sheets are required for the storm sewer in the Empire Lane cul-de-sac. 9. The word "Lane" must be added to the dedication page. 10. A median is required in the driveway at the intersection of Fernbrook Lane and the Fernbrook Lane curb cut for right-in/right-out turns only. 11. If proposed Lot 2 is platted as a lot (as opposed to an outlot) when the final plat for Lot 1 is approved, the applicant shall either constrict the Empire Lane cul-de-sac as part of the phase I constriction, or the development contract shall address fiiture constriction of the cul-de- sac. 12. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. D. Location and number of fire hydrants shall be approved by the Fire Division. E. Submittal and approval of fire flow data prior to filing the Final Plat. F. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. G. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
