HomeMy WebLinkAboutCity Council Resolution 2015-229CITY OF PLYMOUTH RESOLUTION No. 2015-229 RESOLUTION AUTHORIZING THE VACATION OF A STREET, DRAINAGE AND UTILITY EASEMENT WITHIN LOTS 3, BLOCK 1, PLAYHOUSE INDUSTRIAL PARK WHEREAS, a public hearing with respect to said vacation was scheduled for July 28, 2015, in accordance with Minnesota Statutes 412.851 and City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 28, 2015; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on July 28, 2015, to inform any and all interested parties relevant to the vacation of a street, drainage and utility easement within lots 3, Block 1, Playhouse Industrial Park, according to the recorded plat thereof, Hennepin County, Minnesota; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That a street drainage and utility easement within lots 3, Block 1, Playhouse Industrial Park, according to the recorded plat thereof, Hennepin County, Minnesota, described as follows, be vacated: That portion of the permanent easement for street, utility and drainage purposes described in Document No. 4745079, in the office of the Hennepin County Recorder, lying Northerly, Westerly and Northwesterly of a line described as follows: Commencing at a point on the west line of Lot 3, Block 1, PLAYHOUSE INDUSTRIAL PARK, according to the recorded plat thereof, Hennepin County, Minnesota, distant 25.00 feet North of the southwest corner of said lot; thence North along said west line a distance of 459.14 feet to the point of beginning of the line to be described; thence deflecting right 91 degrees 38 minutes 12 seconds a distance of 3.10 feet; thence deflecting left 90 degrees 00 minutes 00 seconds a distance of 129.14 feet; thence deflecting right 45 degrees 00 minutes 00 seconds to the southerly right of way line of State Trunk Highway No. 55 and said line there terminating. FURTHER, that said vacation shall not effect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. FURTHER, that the recording of this resolution shall be recorded with, but prior to the recording of Don Gene Addition plat. APPROVED by the City Council on this 28th day of July, 2015.
