RESOLUTION No. 2015-228
RESOLUTION AUTHORIZING THE VACATION OF AN
EASEMENT FOR STORM DRAINAGE PURPOSES
WITHIN THE SOUTHEAST IA OF THE NORTHEAST IA, SECTION 35-118-22
WHEREAS, a public hearing with respect to said vacation was scheduled for July 28, 2015, in
accordance with Minnesota Statutes 412.851 and City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior
to the meeting of July 28, 2015; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the City Council did hold a public hearing on July 28, 2015, to inform any and all
interested parties relevant to the vacation of an easement for storm drainage purposes within the
southeast % of the northeast %, Section 35-118-22; and
WHEREAS, it was determined by the City Council that said easement is not needed for public
purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That an easement for storm drainage purposes within the southeast % of
the northeast 1/4, Section 35-118-22 described as follows, be vacated:
The North 60 feet of the South 390 feet of the West 180 feet of the Southeast Quarter of
the Northeast Quarter of Section 35, Township 118, Range 22, Hennepin County,
Minnesota, as set out in Hennepin County Recorder Document No. 4565538.
FURTHER, that said vacation shall not effect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and
storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to
continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair,
replace, remove, or otherwise attend thereof.
FURTHER, that the recording of this resolution shall be recorded with, but prior to the
recording of Fretham 24th 2nd Addition plat.
