RESOLUTION No. 2015-217
RESOLUTION APPROVING ENCROACHMENT AGREEMENT
FOR A DECK WITHIN A DRAINAGE AND UTILITY EASEMENT ON
LOT 13, BLOCK 5, PLYMOUTH OAKS
WHEREAS, property owners, requested the City to approve an encroachment agreement for a
deck within a drainage and utility easement on Lot 13, Block 5, Plymouth Oaks; and
WHEREAS, the encroachment agreement permits the deck to be located within the drainage and
utility easement in accordance with the survey sketch attached to the encroachment agreement and all
related facilities must still meet all applicable City codes; and
WHEREAS, the existing deck that was constructed approximately 20 years ago is due for
replacement and the proposed deck will be constructed to a size slightly larger than the existing deck.
WHEREAS, the owners property is legally described as Lot 13, Block 5, Plymouth Oaks Hennepin
County, Minnesota.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of
Plymouth, the encroachment agreement for the deck located in the drainage and utility easement.
APPROVED by the City Council on this 28th day of July, 2015.
