HomeMy WebLinkAboutCity Council Resolution 2015-209CITY OF PLYMOUTH RESOLUTION No. 2015-209 RESOLUTION APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND VARIANCE FOR VANMAN ARCHITECTS AND BUILDERS FOR A WAREHOUSE ADDITION AND RELATED SITE IMPROVEMENTS AT 5455 HIGHWAY 169 (2015046) WHEREAS, Vanman Architects and Builders has requested approval of a site plan amendment, conditional use permit, and variance to allow construction of a 9,500 square foot warehouse addition and related site improvements at Once Innovations located at 5455 Highway 169, legally described as follows: The East 398 feet of Lot 1, Block 1, LORELI'S ADDITION, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Vanman Architects and Builders for a site plan amendment, conditional use permit, and variance, subject to the following conditions: 1. A site plan amendment is approved to allow a 9,500 square foot warehouse addition and related site improvements, in accordance with the plans received by the city on June 9, 2015, except as amended by this resolution. 2. A conditional use permit is approved to allow continuation of a lawfully nonconforming (grandfathered) building setback from the north (side) lot Line, with the finding that all applicable conditional use permit standards would be met. 3. A variance is approved to allow continuation of a lawfully nonconforming (grandfathered) parking setback from the south (side) lot line, with the finding that all applicable variance standards would be met. 4. A separate building permit is required prior to commencement of the project. 5. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Complete a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain city approval of final construction plans. c. Silt fence shall be installed prior to any grading or construction on the site. d. Revise the landscaping plan to indicate a minimum caliper of 2.5 inches for the maple tree. e. Revise the roof plan for the new addition so that no rooftop runoff drains to the north or flows onto the property located to the north. Resolution 2015-209 File 2015046 Page 2 6. If project construction would involve the need to temporarily enter upon abutting properties, the applicant or landowner is responsible for obtaining those permissions privately prior to project commencement. The city is not a party to any such right -of -entry agreements or temporary construction easements that may be needed. 7. The number of parking spaces required for this specific use has been reduced from 33 to 30. If parking demand for the site increases beyond what is provided on the site, the property owner shall be responsible for increasing the supply of parking. Additionally, if the building is further expanded in the future, or the use changes, or the ratio of office to warehouse spaces changes, the city reserves the right to conduct a review of the parking needs and may require that additional parking be provided on the site at that time. 8. As part of construction of the warehouse addition, the entire building must be served by a fire sprinkler system. 9. Standard Conditions: a. Any rooftop equipment shall be screened or painted to match the building. b. Separate building permits are required for retaining walls 48 inches in height or higher. c. Any signage shall complywith section 21155 of the zoning ordinance and shall receive sign permits if required. d. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. The site plan amendment, conditional use permit, and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09, 21015.07, and 21030.06 of the zoning ordinance, respectively.
