FOR IMMEDIATE RELEASE December 20, 2006 News Media Contact: Rebecca Fisher (202) 418-2359 FCC Adopts Rules to Ensure Reasonable Franchising Process for New Video Market Entrants Washington, DC — The Federal Communications Commission (FCC) today adopted a Report and Order and Further Notice of Proposed Rulemaking that establishes rules and provides guidance to implement Section 621(a)(1) of the Communications Act of 1934, which prohibits franchising authorities from unreasonably refusing to award competitive franchises for the provision of cable services. In the Order, the Commission concludes that the current operation of the franchising process constitutes an unreasonable barrier to entry that impedes the achievement of the interrelated federal goals of enhanced cable competition and accelerated broadband deployment. The Order addresses several ways by which local franchising authorities are unreasonably refusing to award competitive franchises. These include drawn-out local negotiations with no time limits; unreasonable build -out requirements; unreasonable requests for "in-kind" payments that attempt to subvert the five percent cap on franchise fees; and unreasonable demands with respect to public, educational and government access (or "PEG"). To eliminate the unreasonable barriers to entry into the cable market, and to encourage investment in broadband facilities, the Commission: ■ Found that franchising negotiations that extend beyond certain time frames amount to an unreasonable refusal to award a competitive franchise within the meaning of Section 621(a)(1); ■ Found that requiring an applicant to agree to unreasonable build -out requirements constitutes an unreasonable refusal to award a competitive franchise; ■ Found that, unless certain specified costs, fees, and other compensation required by local franchising authorities are counted toward the statutory five percent cap on franchise fees, demanding them could result in an unreasonable refusal to award a competitive franchise; ■ Found that it would be an unreasonable refusal to award a competitive franchise if the local franchising authority denied an application based on a new entrant's refusal to undertake certain unreasonable obligations relating to public, educational, and governmental ("PEG") and institutional networks ("I -Nets"); and Preempted local laws, regulations, and requirements, including local level -playing -field provisions, to the extent they impose greater restrictions on market entry than the rules adopted herein. The Commission concluded that although the record allows it to determine generally what constitutes an "unreasonable refusal to award an additional competitive franchise" at the local level, the Commission does not have sufficient information to make such determinations with respect to franchising decisions made at the state level or in compliance with state statutory directives, such as statewide franchising decisions. As a result, the Order addresses only decisions made by county- or municipal -level franchising authorities. The Commission also adopted a Further Notice of Proposed Rulemaking in which it seeks comment on how its findings in the Order should affect existing franchisees, tentatively concludes that the findings should apply to existing franchisees at the time of their next franchise renewal process, and seeks comment on the Commission's statutory authority to take this action. The Commission will conclude this rulemaking and release an order no later than six months after the release of the Order. The Commission adopted a Notice of Proposed Rulemaking on November 3, 2005 to seek public comment on these issues. Workshop attendees will have the opportunity to attain Minnesota Pollution Control Agency (MPCA) Level One Certification in Snow and Ice Control Best Practices. They will gain strategies to save money and protect our area lakes and rivers while keeping parking lots and sidewalks safe. Salt is an excellent deicing chemical for parking lots and sidewalks. He provided the following information related to the average daily population at the ACF. ■ The Department of Corrections, which is the licensing authority for the ACF, has approved beds for the ACF as follows: o Men's 395 o Women's 110 o Work Release 172 TOTAL 677 The 677 figure is substantially higher than the 601 figure that is identified in the ACF's conditional use permit. It is also higher than the November population of 648. ■ The State Fire Marshall has signed off on the current arrangements for sleeping higher numbers of inmates than there are cells. The ACF has added sprinklers, increased ventilation and added fire escapes to meet required life safety standards. City staff found these measures acceptable. ■ February, March and October tend to be the peak population months at the ACF. The weekends are the highest population days of the week. ■ In 2003, the State Legislature passed a law that prisoners with less than six months remaining on a felony sentence shall serve the remainder of their term in a county facility. This is the largest single reason why the average daily population has been increasing. ■ The Legislature is considering amending the 2003 law to increase the six months to one year. This would result in additional increases in the average daily 1C population at the ACF. If the City Council is concerned about further increases in inmate population, this issue could be added to the City's 2007 legislative agenda. In addition to the increases associated with the 2003 law, increased enforcement in the City of Minneapolis has resulted in increases in the inmate population. How long this heightened level of enforcement will continue is an unknown. To offset part of the population increases, the ACF has increased the number of offenders that are placed on home monitoring. Currently, the average stay at the ACF is 33 days. The CPI -U has increased by 5.5% from November 2004, to November 2006. As a consequence, the salary for the Mayor should increase from $1,049 to $1,107 per month. The salary for a City Council member should increase from $760 to $802 per month. I have attached a copy of the calculations for your review and the file. If you approve the calculation, please let me know so I can notify payroll and have Sandy update the City Code. YOUTH ADVISORY COUNCIL MEETING MINUTES November 20, 2006 6:30 PM PLYMOUTH CITY HALL Council Members Present Absent Kristen Letich X Mark McKee X Anne Gottwalt X Christopher Fei X Lindsey Beste X Neha Singh X Office Support Representative Kim Olson was also present. The meeting was called to order at 6:37 PM. Presentations: There were no presentations. Approvals: a) Anne made a motion, seconded by Chris, to approve the agenda as presented. The motion passed in a unanimous voice vote. b) Kristen made a motion, seconded by Lindsey, to adopt the minutes of the October 301h meeting. The motion passed in a unanimous voice vote. Council Update: Kim reported that a new mayor and ward two councilmember had been elected in the November elections and their terms will begin in January. Special Items: a) Discussion of goals and objectives Anne stated that they will need to begin working with the City's senior coordinator to plan the next intergenerational event. The Council discussed an event with a possible knitting theme. The Council discussed setting up speakers for the leadership conference. They agreed that they would like to have two speakers but want to make sure that the speakers are engaging for audience. The Council decided to hold the leadership conference in March. The Council discussed holding a fund-raising event to benefit charity. They discussed possible carnival themes including games, food, etc. The Council agreed that the event needed to be held during warm weather and at a time when all students and the community as a whole can be involved. Kristen suggested contacting businesses as early as January to begin asking for donations. Kristen stated that she will get in touch with the Plymouth Lions to see if and how much they will be able to sponsor for the Youth Service Awards. She stated that last year they had indicated the need to share the sponsor responsibility. The Council would like to see the event held in May but no specific date was set.
