RESOLUTION No. 2015-190
RESOLUTION APPROVING REQUEST FOR PAYMENT NO. 3 AND FINAL
2014 RETAINING WALL PROJECT
CITY PROJECT NO. 14017
WHEREAS, the City of Plymouth as the owner and Jeremy Janson Construction as the contractor,
have entered into an agreement for the 2014 Retaining Wall Project, City Project No. 14017, said
agreement was approved by the City Council on August 26, 2014; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final
request for payment.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $105,576.00 and that the value of the work to date is
$116,205.95 and is herewith approved. The final contract amount is $10,629.95 or 10% above
the original contract amount.
2. That the work performed by the contractor for the 2014 Retaining Wall Project and certified to
the Council by the engineer as acceptable, being the same, is hereby released from the contract
except as to the conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $13,221.67 to Jeremy Janson
Construction for the 2014 Retaining Wall Project is hereby approved and the Administrative
Services Director is hereby authorized and directed to pay the same forthwith.
4. Funding for this project will be through the street replacement fund ($97,858.90) and from the
funds received from the Deerhaven Homeowners Association ($28,367.85).
APPROVED by the City Council this 23rd day of June, 2015.
