RESOLUTION No. 2015-176
RESOLUTION APPROVING A VARIANCE FOR IMPERVIOUS SURFACE COVERAGE TO ALLOW
CONSTRUCTION OF A HOME ADDITION BY SKYLINE DESIGN, INC. FOR PROPERTY LOCATED
AT 1 165 BLACK OAKS LANE NORTH (2015038)
WHEREAS, Skyline Design, Inc. has requested approval of a shoreland variance to allow
construction of a home addition; and
WHEREAS, the subject property is legally described as Lot 56, Block 2, Cimarron Ponds,
Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request by Skyline Design, Inc. for a
shoreland variance to allow construction of a home addition for property located at 1165 Black
Oaks Lane North, subject to the following:
1. The requested variance is hereby approved to allow 50 percent impervious surface coverage
where 25 percent coverage is permitted, in accordance with the application received by the
city on April 29, 2015, except as may be amended by this resolution.
2. The 15 -foot by 20 -foot addition shall be constructed with similar materials and colors as the
existing home.
3. The requested shoreland variance is approved, based on the finding that all applicable
variance standards would be met, as follows:
a) The variance permitting the home expansion is consistent with the residential uses
listed for this land use classification in the comprehensive plan.
b) The applicant has proposed to replace a seasonal patio with a deck and construct an all -
season room. The addition would be designed to blend into the design of the home
with similar materials and colors.
c) The applicant has established that there are practical difficulties in complying with the
ordinance. "Practical difficulties" means that:

1. The applicant proposes to use the property in a reasonable manner not permitted by
the zoning ordinance;
2. The plight of the homeowner is due to circumstances unique to the property that
were not created by the landowner; and,
3. The variance would not alter the essential character of the locality.
d) The request is not based exclusively upon economic considerations.
e) Granting the variance would not be detrimental to the public welfare or injurious to
other land or improvements in the neighborhood. The applicant is proposing to finish
the room addition with the same materials used on the exterior of the home and is
designed similarly with additions on other nearby homes. The addition would also
comply with all other zoning ordinance requirements.
f) The proposed addition would not impair an adequate supply of light and air to adjacent
properties, nor would it substantially increase congestion of public streets, increase the
danger of fire, endanger the public safety, or substantially diminish or impair property
values within the neighborhood.
g) The requested variance appears to be the minimum action required to eliminate the
hardship and to allow the homeowner to improve the livability of the home and to
provide additional space. To reduce the impact of the addition, the applicant would
replace an existing concrete patio with a deck which would limit the amount of added
impervious surface.
4. A building permit is required prior to construction of the room addition.
5. Prior to final inspection, the applicant shall remove the concrete patio.
6. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
7. The variance shall expire one year after the date of approval, unless the property owner or
applicant has commenced the authorized improvement or use, or unless the applicant, with
the consent of the property owner, has received prior approval from the city to extend the
expiration date for up to one additional year, as regulated under section 21030.06 of the
zoning ordinance.
