HomeMy WebLinkAboutCity Council Resolution 2001-557CITY OF PLYMOUTH RESOLUTION NO. 2001-557 AUTHORIZING THE VACATION OF A UTILITY EASEMENT FOR SANITARY SEWER PURPOSES RECORDED UNDER DOCUMENT NUMBER 4749883 WI4EREAS, a petition was received to vacate a permanent easement for sanitary sewer purposes within Parcel 14-118-22-32-0007; and WI4EREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WI4EREAS, a public hearing with respect to said vacation was scheduled for December 18, 2001 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WIffiREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 18, 2001; and WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WIffiREAS, the Council did hold a public hearing on December 18, 2001 to inform any and all interested parties relevant to the vacation of the permanent utility easement for sanitary sewer purposes within Parcel 14-118-22-32-0007; and WI4EREAS, it was determined by the City Council that said easement was not needed for public purposes; ('_54933CCR 2001 5?Z.doc Resolution No. 2001-557 Page 2 of 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following permanent utility easement for sanitary sewer purposes be vacated: A permanent utility easement for sanitary sewer purposes over, under, across and through the north 267.5 feet of the West 30 feet and the North 20 feet of the East 132 feet of the following described property: The South 172.64 feet of the North 420.14 feet of the East 162 feet of the Northwest 1/4 of the Southwest 1/4 of Section 14, Township 118, Range 22, also that part of the West 30 feet of the East 162 feet of the North 247.5 feet of said Northwest 1/4 of the Southwest 1/4 lying South of County Highway Number 9, Hennepin County, Minnesota.
