HomeMy WebLinkAboutCity Council Resolution 2001-535CITY OF PLYMOUTH RESOLUTION 2001-535 APPROVING SITE PLAN AMENDMENT AND VARIANCE FOR CONTINENTAL PROPERTY GROUP FOR PROPERTY LOCATED AT 13505 INDUSTRIAL PARK BOULEVARD (2001130) WHEREAS, Continental Property Group has requested approval of a site plan amendment and variance for property legally described as: Lot 1, Block 5, Minneapolis Industrial Park 2`1 Addition: and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Continental Property Group for a site plan amendment and variance, subject to the following conditions: 1. A site plan amendment is approved to remove and reconstruct concrete curb and gutter in the truck dock area and truck entrances to improve truck maneuverability, in accordance with the plans received by the City on October 12, 2001 together with the revised plans received by the City on October 26, 2001, except as amended by this resolution. 2. A variance is approved to allow zero setback for the drive aisle along the south property line property, where 15 feet is the minimum setback specified by the Zoning Ordinance, based on the finding that: Resolution 2001-535 File No. 2001130 Page 2 a) The existing conditions of the property result in a particular hardship to the owner, if the strict letter of the regulations were to be carried out. There is no other area to expand the loading dock area to improve the situation and appearance of the site. b) The circumstance upon which the petition for the variance is requested is unique to the parcel in this case, due to its lawf it non -conforming status with regard to the location of the existing loading area. c) The purpose of the variance is not based exclusively upon a desire to increase the value or income potential of the parcel of land. d) The circumstances surrounding the variance request were not self-created, but rather were existing conditions from when the property was constructed in 1968, prior to the current regulations. e) The proposed improvements would not be detrimental to the public welfare or injurious to other land in the neighborhood. The proposal would improve the appearance of the area. f) The proposed improvements would not impair an adequate supple of light and air to adjacent property, endanger public safety, increase congestion of the public streets, increase the danger of fire or substantially diminish property values in the neighborhood. g) The requested variance would be the minimum action required to eliminate the hardship. 3. Prior to issuance of a grading permit, the applicant shall provide a letter or easement from the adjacent property owner, granting permission to grade on their property. 4. Prior to issuance of a grading permit, the applicant shall provide a financial guarantee and Site Improvement Performance Agreement for all site improvements. 2�5. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance.
