HomeMy WebLinkAboutCity Council Resolution 2001-522CITY OF PLYMOUTH RESOLUTION 2001-522 APPROVING A CONDITIONAL USE PERMIT FOR WOLFGANG AND LINDA BOSS TO ALLOW CONSTRUCTION OF A 28 -FOOT BY 28 -FOOT SECOND ATTACHED GARAGE, FOR PROPERTY LOCATED AT 4270 FOUNTAIN LANE NORTH (2001117) WHEREAS, Wolfgang and Linda Boss have requested a conditional use permit to allow 1,600 -square feet of attached garage on property legally described as follows: Lot 6, Block 1, Holly Creek Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Wolfgang and Linda Boss for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow a total of 1,600 total square feet of attached garage space on property located at 4270 Fountain Lane North, as shown on the application and plans received on September 27, 2001. 2. Materials used for the addition must match the exterior of the existing home. 3. The garage shall not be used to store motorized vehicles, except for recreational vehicles and lawn maintenance equipment for use on the premises. 4. No impervious driveway access to the additional garage is allowed. Resolution 2001-522 (2001117) Page 2 of 2 5. The subject property is subject to a maximum impervious surface coverage of 25 percent. Exceeding that maximum would require approval of a variance. 6. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
