PARTIAL RELEASE OF DEVELOPMENT CONTRACT
CORNERSTONE COMMONS (98094)
PARTIAL RELEASE of the Development Contract granted this 131h day of November,
2001, by the CITY OF PLYMOUTH, a Minnesota municipal corporation ("City").
RECITALS
WIffiREAS, the City of Plymouth and Elim Care Foundation and The Rottlund Company,
Inc. entered into a Development Contract dated November 30, 1998 and December 17, 1998
for the plat of Cornerstone Commons Addition as referenced in that certain certified copy of
Resolution of the City of Plymouth recorded in the office of the Hennepin County Recorder
on March 16, 1999 as Document No. 7077759; and
WIffiREAS, Outlot D, Cornerstone Commons Addition and Outlot A, Cornerstone
Commons Fourth Addition were deeded to Moen Leuer Constriction Inc. and made part of
Plymouth Ponds Business Park Third Addition; and
WIffiREAS, the City has been requested to grant a release of this Development Contract for
Outlot D, Cornerstone Commons Addition, Hennepin County, Minnesota, and Outlot A,
Cornerstone Commons Fourth Addition, Hennepin County, Minnesota; and
WIffiREAS, Outlot D, Cornerstone Commons Addition, Hennepin County, Minnesota, and
Outlot A, Cornerstone Commons Fourth Addition, Hennepin County, Minnesota are now
part of Plymouth Ponds Business Park Third Addition; and
WI-IEREAS, all requirements of the Cornerstone Commons Development Contract for
Outlot D, Cornerstone Commons Addition and Outlot A, Cornerstone Commons Fourth
Addition have been fiilfilled or will be fulfilled by the developer of Plymouth Ponds
Business Park Third Addition under separate agreement.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That Outlot D, Cornerstone Commons Addition,
Hennepin County, Minnesota and Outlot A, Cornerstone Commons Fourth Addition,
Hennepin County, Minnesota be released from the Contract.
Adopted by the City Council on November 13, 2001.
