FOR "FORSTER PRESERVE PLAT 5" FOR PROPERTY LOCATED SOUTH OF ROCKFORD ROAD AND WEST OF DEERWOOD LANE (200111F) WHEREAS, Janco, Inc. has requested approval of a final plat for Forster Preserve Plat 5, containing 9 single family lots for property legally described as follows: Outlot A, Forster Preserve Plat 4, except that part embraced within the Southeast Quarter of the Northeast Quarter of Section 14, Township 118, Range 22, according to the recorded plat thereof, Hennepin County, Minnesota. That part of Outlot A, Forster Preserve Plat 4, embraced within the Southeast quarter of the Northeast Quarter of Section 14, Township 118, Range 22, according to the recorded plat thereof, Hennepin County, Minnesota. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Forster Preserve Plat 5; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 9 single family lots in accordance with the plat and plans received by the City on September 11, 2001 and revisions received on September 26, 2001, October 5, 2001, and October 25, 2001, except as amended by this Resolution. The applicant shall pay park dedication fees in lieu of land dedication, in accordance with the fee schedule in effect at the time of recording the final plat. 3. Prior to recording the final plat, the applicant shall revise the tree preservation plan to identify a listing of all trees with their status indicated. The plan shall identify each tree with a number and shall indicate whether the tree would be saved or removed. If the applicant removes or disturbs over 50 percent of the significant trees on site, reforestation or restitution will be required in accordance with the City's tree preservation ordinance. 4. Prior to issuance of a grading permit, the applicant shall demonstrate compliance with all erosion control ordinances and policies. 5. Development standards shall be as required by the RSF-3 district. No variances are granted or implied. 6. Private driveway access shall be prohibited from Rockford Road. 7. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. Removal of all hazardous trees from the property at the owner's expense. e. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements prior to issuance of building permits. f. Street names shall comply with the City Street Naming System. g. Prior to the issuance of the building permits, the Fire Division shall approve location and number of fire hydrants. h. Prior to the issuance of the building permits, the applicant shall submit fire flow data. i. Prior to the release or reduction of any site improvement guarantees, compliance with the Ordinance is required regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. j. Prior to the release or reduction of any site improvement guarantees, an 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted.
