HomeMy WebLinkAboutCity Council Resolution 2001-484CITY OF PLYMOUTH RESOLUTION 2001-484 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND FIRE LANE VARIANCE TO ALLOW CONSTRUCTION OF AN ACCESSORY BUILDING EXCEEDING 30 PERCENT OF THE GROSS FLOOR AREA OF THE PRINCIPAL STRUCTURE AT 5465 HIGHWAY 169 (2001085) WHEREAS, Ace Properties has requested approval of a site plan amendment, conditional use permit, and fire lane variance for property legally described as follows; The north 90 feet of the south 180 feet of the north 530 feet of the east 796 feet of the south 80 rods of the southeast quarter of the southeast quarter of Section 1, Township 118, Range 22, except the east 175 feet thereof, Hennepin County, Minnesota. The south 90 feet of the north 530 feet of the east 796 feet of the south 60 rods of the southeast quarter of the southeast quarter of Section I, Township 118, Range 22, except the east 175 feet thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ace Properties for a site plan, conditional use permit, and fire lane variance, subject to the following conditions: 1. A site plan amendment and conditional use permit are approved for a 3,936 square foot addition to the existing accessory building, according to the plans and application received by the City on July 25, 2001 and October 15, 2001 except as amended by this resolution. Resolution No. 2001-484 2001087 Page 2 2. A fire lane variance is hereby approved in accordance with the following conditions: a. The existing storage building and the addition to the existing storage building must be protected with a City approved automatic fire sprinkler system. b. A hydrant must be installed on site in an approved location. c. The existing drive on the south side of the existing storage building shall be extended to the western corner of the addition to the existing building. 3. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements prior to issuance of building permits. c. Compliance with the Ordinance regarding the location of post indicator valve, fire department connection, and fire lane signage. d. Prior to the issuance of utility or building permits, fire flow calculations shall be in compliance with City Code/Uniform Fire Code. e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
