HomeMy WebLinkAboutCity Council Resolution 2001-448CITY OF PLYMOUTH RESOLUTION 2001-448 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR JANCO, INC. FOR "WELLSWOOD COURT" FOR PROPERTY LOCATED SOUTH OF GLEASON LAKE DRIVE BETWEEN NIAGARA AND QUANTICO LANES (2001076-F) WHEREAS, Janco, Inc. has requested approval of a final plat for Wellswood Court, a plat of seven single-family lots on a roughly 3.59 -acre site located south of Gleason Lake Drive between Niagara and Quantico Lanes; and WHEREAS, the property is legally described as follows: All that part of the Southeast quarter of southwest quarter of Section 33, Township 118 North, Range 22 West of the fifth principal meridian described as follows: Commencing at a point in the South line of Section 33, which point is 339.8 feet West along said South line from the Southeast corner of said Southwest quarter of said Section and running thence North 13 degrees 33 minutes East 468 feet more or less to South line of Highway running from Minneapolis to Wayzata as now used and traveled; thence Westerly along said South line of said Highway to its intersection with the extension of the West line of the West half of the Northeast quarter of the Northeast quarter of the Northwest quarter of Section 4, Township 117 North, Range 22 West, thence South along said extended West line to the Northwest corner of said West half of the Northeast quarter of the Northeast quarter of the Northwest quarter of Section 4; thence East along the South line of aforesaid Section 33 to the point of beginning, according to the United States Government Survey thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. Resolution 2001-448 (2001076-F) Page 2 of 3 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Janco, Inc. for a final plat for Wellswood Court; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves seven single-family lots in accordance with the plans received by the City on September 11, 2001 and September 12, 2001, except as amended by this Resolution. 2. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication, pursuant to the Dedication Policy in effect at the time of recording the final plat, for seven new dwelling units. 3. Prior to recording the final plat, the developer shall submit the required street easement for Gleason Lake Drive. 4. Prior to issuance of any building permits, the applicant shall enter into a Site Improvement Performance Agreement and shall provide a financial guarantee for landscaping of the cul-de- sac island. 5. The cul-de-sac island shall be maintained by a homeowner's association. The homeowner's association documents shall be approved by the City and filed with the County at the time the final plat is recorded. 6. Compliance with the City's tree preservation regulations. 7. Any signage shall comply with the Sign Ordinance. 8. Development standards shall be as required by the RSF-I district. No variances are granted or implied. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. d. No building permits shall be issued until a contract has been awarded for sewer and water, and the MPCA permit is issued. Resolution 2001-448 (2001076-F) Page 3 of 3 e. Private driveway access shall be limited to the internal cul-de-sac street. Private driveway access shall be restricted from Gleason Lake Drive. f. Street names shall comply with the City Street Naming System. g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. h. Compliance with the Ordinance regarding the number and location of fire hydrants. i. Prior to filing the final plat, submission and approval of fire flow calculations. j. A pond maintenance agreement is required between the developer and the City for the water quality pond. k. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
