RESOLUTION 2001-414
APPROVING VARIANCE TO THE SIGN REGULATIONS TO ALLOW TENANT
WALL SIGNS ON TWO STREET FRONTAGES FOR A MULTI -TENANT RETAIL
BUILDING FOR PROPERTY LOCATED AT 17405 COUNTY ROAD 6. (2001094)
WHEREAS, an application has been filed by Oakwood Square, LLC. which requests
approval of a sign variance to permit tenant signs on two sides of a building, where the
ordinance would only allow wall signs on one side of the building on property legally
described as follows:
Lot 2, Block 1, Oakwood Square
WHEREAS, the Planning Commission has reviewed the request at a duly called public
meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Oakwood Square, LLC. for a sign variance to allow tenant wall signs on two
building walls on property located at to be located at 17405 County Road 6, subject to the
following conditions:
1. This resolution approves a variance to allow tenant wall signs on two building walls,
the north and west sides, on a building located at 17405 County Road 6, in accordance
with the plans and application received by the City on August 1, 2001, except as
amended by this resolution.
2. The variance for tenant wall signs on two building walls is approved with the finding
that the applicable variance standards are met. Specifically:
a. The situation presents a particular hardship unique to this property and is not
generally applicable to other retail properties due to the particular placement of
buildings on the related properties. All the entrances to the tenant spaces and their
signs are on the west side of the subject building (except for the non -conforming

"Tobacco" sign). However, the tenant signs are partially blocked from view
because of the location of the motor fuel/service station, which is situated between
the multi -tenant retail building and County Road 101.
b. This situation is unique to this property because the space between the motor
fuel/service station and the retail building is narrower than with most shopping
centers. Typically a parking lot divides the different buildings in a retail center.
The expanse of a parking lot allows for greater space between buildings and
therefore wider view corridors to the individual tenant signs.
c. The request for the variance is related to continued viability of the center in an ever
more competitive retail environment.
d. The hardship is caused by the limited spacing between the multi -tenant retail
building on the subject property and the adjacent motor fuel/service station and the
resulting limited visibility from County Road 101 and is not self created.
e. Approval of the sign variance will have no effect on the public welfare or be
injurious to other land or improvements in the neighborhood.
f. The proposed sign would not impair an adequate supply of light and air to adjacent
property or substantially increase the congestion of the public streets, increase the
danger of fire, endanger the public safety, or substantially diminish or impair
property values within the neighborhood.
g. The requested variance is the minimum action required to eliminate the hardship.
3. The total signage on each wall shall be calculated separately and shall not exceed the
amount specified by the Zoning Ordinance.
4. The applicant must obtain a separate sign permit, prior to any replacement of any
existing signs or the installation of any additional signs.
5. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
6. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless the
landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of
the Zoning Ordinance.
