HomeMy WebLinkAboutCity Council Resolution 2001-413CITY OF PLYMOUTH RESOLUTION 2001-413 APPROVING A VARIANCE FOR IMPERVIOUS SURFACE COVERAGE IN THE SHORELAND MANAGEMENT OVERLAY DISTRICT FOR AN ADDITION FOR GAIL AND LINDA DIELEMAN ON PROPERTY LOCATED AT 11705 45"' AVENUE NORTH (2001096) WHEREAS, an application has been filed by Gail and Linda Dieleman requesting approval of a variance for approximately 28.3 percent impervious surface area coverage where the Zoning Ordinance permits 25 percent coverage, and WHEREAS, the variance would allow constriction of a 378 square foot addition on the property, and WHEREAS, the subject property is legally described as: Lot 12, Block 3, Deerwood Meadows, Hennepin County, Minnesota, and WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Gail and Linda Dieleman for a variance for approximately 28.3 percent impervious surface area coverage where the Zoning Ordinance permits 25 percent coverage, for property located at 11705 45th Avenue North, subject to the following findings and conditions: 1. This variance is granted in accordance with the plans received by the City on August 7, 2001, except as may be amended by this resolution. Resolution 2001-413 (2001096) Page 2 2. The variance is granted based upon findings that the applicable variance standards have been met, as follows: a. as the home was built prior to the current shoreland district requirements, a particular hardship to the owner would result, if the strict letter of the regulations were to be carried Out b. assuming a driveway coverage of 738 square feet and the substitution of a wood deck, the proposed addition would result in a neglible increase in impervious surface coverage c. granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. 3. The brick paver patio shall be replaced with a deck platform shall be made of wood with spacing such that it is pervious and the soil underneath not be compacted. 4. No additional impervious surface coverage shall be allowed on this parcel unless in the future scientific data is provided to document that brick pavers are considered pervious. 5. The appropriate building permits must be obtained prior to constriction of the addition. 6. This approval shall expire one year after the date of approval, unless the applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
