HomeMy WebLinkAboutCity Council Resolution 2001-410CITY OF PLYMOUTH RESOLUTION 2001-410 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR A 13,225 SQUARE FOOT MONTESSORI SCHOOL TO BE LOCATED AT THE NORTHWEST CORNER OF STATE HIGHWAY 169 (FRONTAGE ROAD) AND ROCKFORD ROAD (2001087) WHEREAS, Step By Step Montessori has requested approval of a site plan and conditional use permit for property legally described as follows; That part of Lot 2 and the east 44.00 feet of Lot 1 lying south of the north 494.72 feet thereof and Lot 3 except that part thereof lying westerly of a line drawn parallel with and distant 44.00 feet west of the west line of said Lot 2 and its southerly extension and lying north of the easterly extension of the north line of Lot 5, all in Block 1, MEYER GONYEA ADDITION, according to the plat thereof on file and of record in the office of the County Recorder, in and for Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Step by Step Montessori for a site plan and conditional use permit subject to the following conditions: A site plan is approved for an approximately 13,225 -square foot daycare building, according to the plans and application received by the City on July 26, 2001 and August 9, 2001, except as amended by this resolution. 2. A conditional use permit is approved a daycare facility is approved, except as amended by this resolution. Resolution No. 2001-410 2001087 Page 2 3. Prior to issuance of a building permit, the elevation plan shall be revised to substitute integrally colored materials for those proposed and substitute integrally colored burnished block for the smooth -faced concrete block proposed in conformance with the Zoning Ordinance. 4. Prior to the issuance of any permits, the project shall be reviewed and approved by the Bassett Creek Watershed District and all conditions of their approval shall be incorporated into the plans. 5. Prior to issuance of building permits, the applicant shall submit a revised lighting plan, including fixture details, in conformance with the Zoning Ordinance standards. 6. The applicant shall be encouraged to work with staff to comply with the wetland buffer and setback requirements of the Zoning Ordinance. 7. A copy of the State of Minnesota Department of Human Services license for this property shall be submitted to the City. 8. Signage for this site shall be in compliance with the Sign Ordinance. Separate sign permits shall be required. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, and fire lane signage. d. Prior to the issuance of utility or building permits, fire flow calculations shall be in compliance with City Code/Uniform Fire Code. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
