HomeMy WebLinkAboutCity Council Resolution 2001-407CITY OF PLYMOUTH RESOLUTION 2001-407 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR DAVE REIMER CONSTRUCTION, INC. FOR "GRAVIERE 2N" ADDITION" FOR PROPERTY LOCATED NORTH OF COUNTY ROAD 6 AND EAST OF DUNKIRK LANE (2001010-F) WHEREAS, Dave Reimer Constriction, Inc. has requested approval of a final plat for Graviere 211a Addition, a plat of 15 lots for 14 townhome units on a 2.58 -acre site located north of County Road 6 and east of Dunkirk Lane; and WHEREAS, the property is legally described as Lots 1, 2, and 3, Block 1, Graviere Addition; and WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Dave Reimer Constriction, Inc. for a final plat for Graviere 2"a Addition; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 15 lots for 14 townhome units in accordance with the plans received by the City on August 15, 2001, except as amended by this Resolution. 2. Minimum building setbacks shall be specified by the RMF -2 zoning district, except that a variance was approved to allow a corner portion (roughly 35 square feet in area) of the townhome on Lot 8 to be set back 20 feet from the proposed Comstock Lane right-of-way. Resolution 2001-407 (2001010-F) Page 2 of 3 3. The private drives shall be signed at the entrance points as private drives, and shall indicate the range of addresses that they serve. 4. The private drives shall provide unobstructed access and shall be maintained as a fire lane at all times. 5. The developer shall restore any portion of the trail along County Road 6 that is damaged as a result of the development. The trail shall not be used for access or storage. 6. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication for 14 dwelling units, pursuant to the Dedication Policy in effect at the time of recording the final plat. 7. Prior to recording the final plat, the developer shall provide evidence that the necessary easements were obtained from the neighboring landowners. 8. The Developer shall comply with the City's Tree Preservation Ordinance. 9. If damage occurs to any significant trees located beyond the boundaries of any grading easement area as a result of the development, the developer shall replace those trees on the neighboring site at a 1.0 inch to 1.25 inch ratio. 10. The applicant shall provide information on the rain garden and its related plantings, to demonstrate compliance with the City's Water Resources Management Plan. 11. There shall be one Homeowners Association for the development. Maintenance of the common areas, including but not limited to the retaining walls, fences, signage, and private drives shall be addressed in the Homeowners Association documents. 12. The location and number of fire hydrants shall be approved by the Fire Division. Some of the units may require a fire sprinkler system. 13. Prior to issuance of building permits, submission of a Site Improvement Performance Agreement. 14. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Street names shall comply with the City Street Naming System. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. Resolution 2001-407 (2001010-F) Page 3 of 3 e. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. f. No building permits shall be issued until a contract has been awarded for constriction of municipal sewer and water, and the MPCA is issued. g. Private driveway access shall be limited to internal public roads and restricted from County Road 6. h. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. i. Submittal of fire flow data prior to filing the final plat. j. Compliance with the Ordinance regarding the number and location of fire hydrants, fire lanes, and fire lane signs. k. A pond maintenance agreement is required between the developer and the City for the water quality ponds. 1. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
