HomeMy WebLinkAboutCity Council Resolution 2001-399CITY OF PLYMOUTH RESOLUTION 2001-399 APPROVING A PUD AMENDMENT TO ALLOW BUILDING HEIGHT OVER 35 FEET AND REDUCED FRONT YARD SETBACKS, A CONDITIONAL USE PERMIT TO ALLOW FOUR BUILDINGS ON ONE LOT, AN INTERIM USE PERMIT TO ALLOW REDUCED PARKING, AND A FIRE LANE VARIANCE FOR THE RESERVE APARTMENTS IN THE RESERVE PUD, LOCATED WEST OF I-494 AND NORTH OF THE CANADIAN PACIFIC RAILROAD (2001070) WHEREAS, North American Properties has requested a PUD (Planned Unit Development) amendment for property legally described as: Lot 8, Block 9, The Reserve WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of North American Properties, subject to the following findings and conditions: 1. A PUD amendment is granted to allow building heights over '15 feet and reduced front yard setbacks for The Reserve apartments, in accordance with the application and plans received by the City on June 28, 2001 and revisions received on August 14, 2001. 2. A conditional use permit is approved to allow more than one principal building on a lot, with the finding that all the applicable general standards are met. 3. An interim use permit for reduced parking is approved to allow installation of 722 parking spaces rather than 902 parking spaces, with the finding that all applicable interim use permit standards are met. The City may terminate the interim use permit if a parking shortage is Resolution 2001-399 (2001070) Page 2 observed on the site. In such case, the applicant would be required to constrict additional parking spaces on the site. 4. A fire lane variance to allow a fire lane further than 50 feet from the east side of building one on the south end of the project is hereby approved, subject to the following: a. The entire building shall be protected by a City -approved NPFA 13 automatic fire sprinkler system. b. The entire building shall be protected by a City -approved automatic fire alarm system. c. Approved Fire Department standpipes must be located in approved locations within the building. d. Site fire hydrants shall be in City -approved locations. e. A City -approved fire lane shall extend around the entire perimeter of the building. f. The apartments shall be constricted in accordance with all approved standards and conditions of the PUD general plan, except as amended by this resolution.
