RESOLUTION NO. 2001-392
RESOLUTION IMPOSIGN A CIVIL PENALTY
AGAINST DAVANNI'S, INC.
d/b/a DAVANNI'S PIZZA & HOT HOAGIES
FOR LIQUOR COMPLIANCE CHECK VIOLATION
WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed
liquor establishments within the City; and
WHEREAS, during one of these checks conducted on May 28, 2001, an individual employed at
Davanni's, located at 3015 Harbor Lane, sold alcoholic beverage to an underage person; and
WHEREAS, this establishment had previous compliance check violations which occurred on
December 29, 1999 and December 27, 2000, which are within the three year period the
ordinance requires making this the third violation at this establishment; and
WHEREAS, Minnesota State Statute and Plymouth City Code allow for administrative civil
penalties against the license holders for such violations.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, the City Council adopt the resolution imposing civil penalties against
Davanni's, Inc. d/b/a Davanni's Pizza & Hot Hoagies for:
• Imposition of the 5 -days license suspension which was stayed after the 2" a violation.
• Imposition of a $2,000 fine and 15 -day license suspension for the third violation.
Adopted by the City Council on September 25, 2001.
