HomeMy WebLinkAboutCity Council Resolution 2001-391CITY OF PLYMOUTH RESOLUTION NO. 2001-391 RESOLUTION IMPOSIGN A CIVIL PENALTY AGAINST RAINBOW FOOD GROUP, INC. d/b/a RAINBOW FOODS 473 FOR LIQUOR COMPLIANCE CHECK VIOLATION WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed liquor establishments within the City; and WHEREAS, during one of these checks conducted on May 26, 2001, an individual employed at Rainbow Foods 473, located at 16705 County Road 24, sold alcoholic beverage to an underage person; and WHEREAS, that individual was also a juvenile with a DOB of October 1, 1983 making him 17 years of age at the time of the sale; and WHEREAS, this establishment had previous compliance check violations which occurred on July 16, 1999 and December 27, 2000, which are within the three year period the ordinance requires making this the third violation at this establishment; and WHEREAS, Minnesota State Statute and Plymouth City Code allow for administrative civil penalties against the license holders for such violations. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, the City Council adopt the resolution imposing civil penalties against Rainbow Food Group, Inc. d/b/a Rainbow Foods 473 for: • Imposition of the 10 -days license suspension which was stayed after the 2" a violation. • Imposition of $2,000 fine and 40 -day license suspension for the third violation.
