RESOLUTION 2001-367
APPROVING CONDITIONAL USE PERMIT AND VARIANCE TO ALLOW
INSTALLATION OF A MONOPOLE ANTENNA TOWER AND RELATED
EQUIPMENT SHELTER FOR WIRELESS COMM[_]NICATION SERVICES AT THE
HAMEL VFW, 19020 HAMEL ROAD (2001046)
WHEREAS, Ulteig Engineers has requested approval of a conditional use permit and
variance for a 125 -foot high monopole tower to be located on the following described
property:
That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118,
Range 22 West of the Fifth Principal Meridian described as follows to wit:
Beginning at the intersection of the west line of said Northwest quarter of Southwest
quarter and the north line of the Rockford Road; thence North along the west line of said
Northwest quarter of the Southwest quarter 125 feet; thence East and parallel to the
North line of said Rockford Road 134 feet; thence North and parallel to the west line of
said Northwest quarter of the Southwest quarter to the south line of the right of way of
the Minneapolis, Saint Paul, Sault Ste. Marie Railway; thence East along the south line of
said railway right of way to the westerly line of State Highway No. 55; thence
Southeasterly along the west line of said State Highway No. 55 to the north line of the
Rockford Road; thence westerly along the north line of said Rockford Road to a point 420
feet East of the intersection of the west line of said Northwest quarter of the Southwest
quarter and the north line of said Rockford Road; thence due North 12 rods; said last
described course thereinafter referred to as line "A"; thence westerly and parallel with the
north boundary line of said Rockford Road a distance of 230 feet; thence due South to the
north boundary line of said Rockford Road; thence westerly along the north boundary line
of said Rockford Road to point of beginning.
EXCEPT that part thereof lying East of the extension of said line "A". Subject to an
easement for driveway purposes over and along the following described premises;

Commencing at a point on the south line of said railway right of way 134 feet east of the
intersection of the west line of the said Northwest quarter of the Southwest quarter and
the south line of said railway right of way; thence South and parallel to said west line of
said Northwest quarter of Southwest quarter 1 rod; thence East and parallel to the South
line of said railway right of way to a point 1 rod west line of said State Highway No. 55;
thence South and parallel to the west line of said State Highway No. 55, 200 feet; thence
Northeasterly and parallel to the south line of said railway right of way to the west line of
said State Highway No. 55; thence Northwesterly along the west line said State Highway
No. 55 to the intersection of State Highway No. 55 and the south line of the said railway
right of way; thence along the south line of said railway right of way to beginning.

Commencing at a point in the Northerly line of Rockford Road distant 190 feet Easterly
along same from west line of Section 7; thence due North 12 rods; thence Easterly parallel
with said road 230 feet; thence due South 12 rods; thence Westerly to beginning, all in
Section 7, Township 118, Range 22.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Ulteig Engineers for a conditional use permit and variance at the Hamel VFW,
subject to the following conditions:
1. This approval allows a 125 -foot high monopole antenna tower and related equipment
shelter, pursuant to the plans received by the City on June 8, 2001.
2. The conditional use permit is granted with the finding that the proposal: 1) would be
consistent with the Comprehensive Plan; 2) would not be detrimental to the public
health, safety, morals or comfort because the antennas would comply with all State
and Federal Communication requirements; 3) would not be injurious to the use and
enjoyment of other property in the area for the uses already permitted, nor
substantially diminish or impair property values within the neighborhood; 4) would
not impede the development or improvement of surrounding properties; and 5) would
comply with the standards outlined in the Zoning Ordinance.
3. The variance to allow the height to exceed 75 feet is granted with the finding that the
variance: 1) is necessary to provide the required coverage for this area of the City
and not providing this coverage would present a hardship; 2) is not based on a desire
to increase value or income potential of the land; 3) would not be detrimental to the
public welfare or injurious to other land or improvements in the neighborhood in
which the site is located; 4) would not impair an adequate supply of light and air to

adjacent property, or substantially increase the congestion of the public streets, or
increase the danger of fire, or endanger the public safety, or substantially diminish or
impair property values within the neighborhood; 5) is the minimum height needed to
provide adequate coverage and ensure a properly functioning system.
4. The project requires the applicable building permit prior to installation.
5. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
6. If the VFW site or surrounding sites are subdivided in the fiiture, no buildings shall be
constricted in violation of the monopole setback regulations required by the Zoning
Ordinance.
7. Compliance with Fire Division requirements for access, hydrants, and address
signage.
8. The monopole shall have a galvanized finish.
9. The conditional use permit and variance shall expire one-year from the date of
approval, unless the project is substantially completed or an extension is applied for
and granted, as regulated under Sections 21015.07 and 21030.06 (respectively) of the
Zoning Ordinance.
