HomeMy WebLinkAboutCity Council Resolution 2001-365CITY OF PLYMOUTH RESOLUTION 2001-365 APPROVING THE USE OF ALTERNATIVE WETLAND BUFFER STRIPS AND PROVIDING INFORMAL COMMENTS ON A SKETCH PLAN FOR DOMINIUM DEVELOPMENT AND ACQUISITION, LLC FOR A PROPOSED 116 -UNIT APARTMENT DEVELOPMENT TO BE KNOWN AS STONE CREEK VILLAGE FOR PROPERTY LOCATED NORTH OF HIGHWAY 55 AND EAST OF WEST MEDICINE LAKE DRIVE (2001088) WHEREAS, Dominium Development and Acquisition, LLC has requested a sketch plan review for an apartment development to be known as Stone Creek Village; and WHEREAS, the sketch plan application includes a request for approval of the use of alternative wetland buffers in four areas; and WHEREAS, any opinions or comments provided by the City Council on the sketch plan that are not specifically related to the request for alternative wetland buffer strips shall be considered advisory only and shall not constitute a binding decision on the proposed development. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve alternative wetland buffer strips for Dominium Development and Acquisition, LLC for four areas as shown on the sketch plan received by the City on July 26, 2001, and subject to the Zoning Ordinance provisions related to Extraordinary Management Practices for alternative wetland buffer strips including submission of a financial guarantee for maintenance of the alternative wetland buffer strips. FURTHER, the City Council provides the following comments or suggestions on the submitted sketch plan application: 1. Traffic noise from Highway 55 could exceed noise standards established by the Minnesota Pollution Control Agency, the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Mn/DOT policy regarding development adjacent to existing highways prohibits the expenditure of highway fiinds for noise mitigation measures. The developer shall assess the noise situation and take the action necessary to minimize the impact of any highway noise. Resolution 2001-365 (2001088) Page 2 2. The sidewalk plan for this development should provide a safe access directly to the play lots and should delineate the crosswalks from the building entrance through the parking lot to the trail along West Medicine Lake Drive. Additionally, the two segments of sidewalk that end at the garage -access driveways should be extended to tie into other sidewalks. ADOPTED by the City Council on August 28, 2001.
