RESOLUTION 2001-350
APPROVING A CONDITIONAL USE PERMIT AND A FIRE LANE VARIANCE TO
ALLOW INSTALLATION OF A 75 -FOOT MONOPOLE ANTENNA TOWER AND
RELATED EQUIPMENT SHELTER FOR WIRELESS COMM[_]NICATION
SERVICES AT LA COMPTE PARK, 10795 OLD COUNTY ROAD 15. (2001067)
WHEREAS, Ulteig Engineers has requested approval of a conditional use permit and a
fire lane variance for a 75 -foot high monopole tower to be located on the following
described property:
That Portion of Section 36, Township 118, Range 22 West described as follows:
Beginning at a point on the southeasterly line of County Road No. 15 distant 13 6. 10 feet
southwesterly from its intersection with the southwesterly line of County Road no. 6;
thence southwesterly along said southeasterly line of County Road No. 15 to a point
distant 454 feet east from west line of said Section 36 measured at right angles therefrom;
thence south parallel with the west line of said Section 36 to the south line of the north 1/3
of the northwest quarter of the southwest quarter of said Section 36; thence east to a point
distant 344 feet west from the southeast corner thereof, thence northeasterly to a point on
the southwesterly line of the County Road No. 6 distant 200 feet northwesterly from the
east line of said northwest quarter of the southwest quarter; thence northwesterly along
said southwesterly line of County Road No. 6 to a point distant 197.45 feet southeasterly
from its intersection with southeasterly line County Road No. 15; thence southwesterly at
right angles 150.35 feet; thence northwesterly to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Ulteig Engineers for a conditional use permit and fire lane variance at La
Compte Park, subject to the following conditions:

1. A conditional use permit is approved to allow a 75 -foot high monopole tower with
antennas and the related equipment shelter, pursuant to the plans received by the City
on June 20, 2001 with the findings that the proposal would comply with all the
general standards, specifically installation of the monopole 1) would be consistent
with the Comprehensive Plan; 2) would not be detrimental to the public health,
safety, morals or comfort; 3) would not be injurious to the use and enjoyment of
other property in the area nor substantially diminish or impair property values within
the neighborhood; 4) would not impede the development or improvement of
surrounding properties; and 5) would comply with the standards outlined in the
Zoning Ordinance.
2. A fire lane variance is approved, subject to the following conditions:
a. A City approved automatic fire alarm system that is monitored by an approved
LTL central station be installed in the stricture.
b. City approved address/directional signage be installed at the access drive from
Old County Road 15. 12" address numerals of approved color and type be
installed in an approved location on an exterior wall of the stricture.
3. This approval is contingent on the City Council approval of a lease agreement.
4. Lights shall be installed at a height no greater than the existing lights and shall be in
conformance with Section 21105.06.
5. The proposed building shall be constricted of materials compatible with the existing
City building on the site.
6. The project requires a separate building permit prior to installation.
7. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
8. The monopole shall be painted brown to match the existing light poles in the park.
9. The conditional use permit shall expire one year from the date of approval, unless the
project is substantially completed or an extension is applied for and granted, as
regulated under Sections 21015.07 of the Zoning Ordinance.
