HomeMy WebLinkAboutCity Council Resolution 2001-333CITY OF PLYMOUTH RESOLUTION 2001-333 APPROVING SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR RAINBOW FOODS, FOR PROPERTY LOCATED AT 4190 VINEWOOD LANE NORTH (2001056) WHEREAS, Rainbow Foods has requested approval of a site plan amendment and conditional use permit for property legally described as Lot 1, Block 2, Rockford Road Plaza; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Rainbow Foods for a site plan amendment and conditional use permit, subject to the following conditions: 1. A site plan amendment and conditional use permit are approved to allow motor vehicle fuel sales in the southern portion of the Rainbow Foods parking lot, in accordance with the plans received by the City on July 12, 2001, except as amended by this resolution. 8-.2. -Building permits are required prior to commencement of the project. -- - - Formatted: Bullets and Numbering 3. Prior to issuance of building permits, the applicant shall submit a financial guarantee and site improvement performance agreement for site improvements including, but not limited to, landscaping shown on the plan and replacement of dead trees in the area north of 42"1 Place that is owned and maintained by the Rockford Road Plaza Shopping Center. 4. There shall be no outdoor service operation of lubrication equipment, hydraulic lifts of service pits, tire changing, drive systems repair and tuning, or sinrilar operations. Resolution 2001-333 File No. 2001056 Page 2 5. No outside storage, sales, or rental shall be allowed except as specifically alloyed by separate administrative use permit. 6. No outside storage of parts, equipment, or inoperable vehicles shall be allowed. 2-f-.-7. Standard Conditions: a. Compliance with the Engineer's Memo. d-b.The Fire Division shall approve location and number of fire hydrants. g-.c.An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per Cite Policy. fid—. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
