TO CREATE TWO LOTS FROM LOT I BLOCK 2, WALNUT GROVE POND 3880 TROY LANE NORTH (2001058) WHEREAS, an application has been filed by Schoell & Madson, Inc. which requests approval of a Lot Division to create two parcels of land from Lot 1, Block 2, Walnut Grove Pond, as legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for the Lot Division would revise the lot, as legally described on Attachment Two, attached hereto and hereby made a part hereof, and WHEREAS, the City Council has fiilly considered the request for the Lot Division. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Schoell & Madson, Inc. for a Lot Division for Lot 1, Block 2, Walnut Grove Pond, located at 3880 Troy Lane North, subject to the following conditions: 1. This Resolution approves a lot division for Lot I Block 2, Walnut Grove Pond, in accordance with the Plans received by the City on June 4, 2001 and June 26, 2001. 2. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. 3. No building permits shall be issued until the Lot Division is filed and recorded with Hennepin County. 4. Compliance with the City Engineer's Memo. 5. Addressing for the two proposed lots shall comply with the citywide addressing requirements. Resolution 2001-294 (2001058) Page 2 Adopted by the City Council on July 10, 2001. Resolution 2001-294 (2001058) Page 4 ATTACHMENT TWO (PROPOSED LEGAL DESCRIPTIONS) Parcel A: That part of Lot 1, Block 2, WALNUT GROVE POND, according to the recorded plat thereof which lies northeasterly of the following described line and its extensions: Commencing at the most southerly corner of said Lot 1; thence on an assumed bearing of North 27 degrees 50 minutes 18 seconds East, along the southeasterly line of said Lot 1, a distance of 75.00 feet, to the point of beginning of the line to be described; thence North 62 degrees 09 minutes 42 seconds West to the westerly line of said Lot 1 and said line there terminating. Parcel R• That part of Lot 1, Block 2, WALNUT GROVE POND, according to the recorded plat thereof which lies southwesterly of the following described line and its extensions: Commencing at the most southerly corner of said Lot 1; thence on an assumed bearing of North 27 degrees 50 minutes 18 seconds East, along the southeasterly line of said Lot 1, a distance of 75.00 feet, to the point of beginning of the line to be described, thence North 62 degrees 09 minutes 42 seconds West to the westerly line of said Lot 1 and said line there terminating.
