HomeMy WebLinkAboutCity Council Resolution 2001-288CITY OF PLYMOUTH RESOLUTION 2001-288 APPROVING FINDINGS OF FACT FOR REZONING OF CERTAIN LAND CONSISTENT WITH THE GUIDE PLAN CLASSIFICATION IN THE COMPREHENSIVE PLAN (2001042) WHEREAS, the City of Plymouth has initiated a reclassification of the zoning for several parcels located throughout the City to achieve consistency between the land use guide plan and the zoning ordinance map, those reclassifications the legal descriptions for the affected parcels as follows: A. Reclassification from C-3 (Highway Commercial) to O -R (Office/Residential) for 2 parcels located east of Nathan Lane and south of 45th Avenue and legally described as follows: Lot 3, Block 1, Dekoco Addition, and Outlot A, Rockford Square B. Reclassification from I-2 (General Industrial) to O -R (Office/Residential) for 5 parcels located in the southeast quadrant of Highway 55 and Fernbrook Lane and legally described as follows: Lot 10, Block 1, Industrial Park 494 except the road, and Lot 1, Block 1, Industrial Park 494, and Lot 2, Block 1, Industrial Park 494, and Lot 8, Block 1, Industrial Park 494, and Lot 9, Block 1, Industrial Park 494 Resolution 2001-288 (2001042) Page 2 C. Reclassification from RSF-2 (Residential Single Family 2) to P -I (Public/Institutional) for 5 parcels located west of Jonquil Lane and south of 23rd Avenue and legally described as follows: Lot 7, Block 2, Penwallc Addition, and Lot 8, Block 2, Penwallc Addition, and Lot 9, Block 2, Penwallc Addition, and Lot 10, Block 2, Penwallc Addition, and Lot 11, Block 2, Penwallc Addition D. Reclassification from C-2 (Neighborhood Commercial) to O -R (Office/Residential) for 3 parcels located west of County Road 101 and north of 19th Avenue and legally described as follows: Outlot A, Snyders Pine Ridge, and Tract A, Registered Land Survey No. 1221 also the southeasterly 172 feet of Outlot B, Snyders Pine Ridge subject to road easement, and Lot 1, Block 1, Munla Addition E. Reclassification from O -R (Office/Residential) to RMF -4 (Multiple Family 4) for 2 parcels located north of Highway 55 and east of West Medicine Lake Drive and legally described as follows: Commencing at the southwest corner of the northeast quarter of the northeast quarter of Section 35 thence east 727 feet thence deflecting 104 degrees 15 minutes to the left 138 feet to an actual point of beginning thence continuing northwesterly on the last described line 60 feet thence southwesterly at right angles to the center line of the road thence southeasterly along said center line 61.8 feet thence northeasterly to the beginning, excluding road, and Commencing 727 feet east of the southwest corner of the northeast quarter of the northeast quarter of Section 35 thence northwesterly deflecting 104 degrees 15 minutes to the left 138 feet thence southwesterly at right angles 210 feet to the center line of Town Road thence southeasterly on said center line to south line of northeast quarter of the northeast quarter of Section 35 thence east to the beginning, excluding road F. Reclassification from C-2 (Neighborhood Commercial) to RMF -4 (Multiple Family 4) for one parcel located north of Highway 55 and east of West Medicine Lake Drive and legally described as follows: 2 Resolution 2001-288 (2001042) Page 3 Beginning at the southeast corner of Registered Land Survey 1009 thence southerly along the east line of the northeast quarter of the northeast quarter of Section 35 to the north line of the south 497 feet of the northeast quarter of the northeast quarter of Section 35 thence westerly along said north line to an intersection with the westerly line of the east 30 feet of the northeast quarter of the northeast quarter thence southerly along said westerly line to the south line of the northeast quarter of the northeast quarter of Section 35 thence westerly along said south line to a point 727 feet east of the southwest corner thereof thence northwesterly deflecting 75 degrees 45 minutes to the right a distance 198 feet thence southwesterly at right angles to the center line of Medicine Lake Drive west thence northwesterly along said center line to the south line of Registered Land Survey 1009 thence easterly along said south line to the beginning excluding road. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels as described above. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the reclassification of the zoning for the parcels described above, based on the following findings: 1. The proposed rezonings are consistent with the Comprehensive Plan. 2. The existing development is consistent with the uses permitted in the respective zoning districts. 3. There is adequate infrastructure available to support the respective zoning and the development proposed for the affected properties. ADOPTED by the City Council on July 10, 2001.
