HomeMy WebLinkAboutCity Council Resolution 2001-287CITY OF PLYMOUTH RESOLUTION 2001-287 APPROVING LAND USE GUIDE PLAN AMENDMENTS FOR THE CITY OF PLYMOUTH FOR SEVERAL PROPERTIES LOCATED THROUGHOUT THE CITY TO ACHIEVE CONSISTENCY BETWEEN THE LAND USE GUIDE PLAN AND THE ZONING ORDINANCE MAP (2001042) WHEREAS, the City of Plymouth has initiated a reclassification of the land use guiding for several properties located throughout the City to achieve consistency between the land use guide plan and the zoning ordinance map, those reclassifications and the legal descriptions for the affected properties as follows: A. Change the guide plan classification from CO (Commercial Office) to PI (Public/Semi- Public/ Institutional) for property located at 4900 Nathan Lane North and legally described as: Lot 1, Block 1, Epiphany Addition B. Change the guide plan classification from C (Commercial) to IP (Planned Industrial) for properties located south of Highway 55 and north of 28t1' Avenue North and legally described as: Lot 6, Block 1, Circle Star Business Centre -1 Addition, and Lot 7, Block 1, Circle Star Business Centre -1 Addition C. Change the guide plan classification from P -I (Public/Semi-Public/Institutional) to LA -1 (Living Area 1) for properties located west of West Medicine Lake Drive and south of 23rd Avenue North and legally described as: Lot 7, Block 1, Penwallc Addition, and Lot 8, Block 1, Penwallc Addition, and Lot 9, Block 1, Penwallc Addition, and Lot 10, Block 1, Penwallc Addition, and Resolution 2001-287 (2001042) Page 2 Lots 1 and 2, Block 2, Penwalk Addition, and Lots 3 and 4, Block 2, Penwalk Addition, and Lots 5 and 6, Block 2, Penwalk Addition, and Lot 1, Block 1, Penwalk Addition, and Lots 2 and 3, Block 1, Penwalk Addition and that part of Lot 4, Block 1, Penwalk Addition, described as beginning at the northwest corner thereof thence easterly along the north line thereof a distance of 107.53 feet thence deflecting right 85 degrees a distance of 12.7 feet thence southwesterly to a point on the westerly line thereof a distance 28 feet southeasterly from the northwest corner thereof thence northwesterly to the beginning D. Change the guide plan classification from C (Commercial) to CO (Commercial Office) for properties located west of I-494 and south of Carlson Parkway and legally described as: Lot 1, Block 1, Carlson Center 12th Addition, and Lots 2 and 3, Block 1, Carlson Center 12th Addition also that part of Lot 1, Block 1, Carlson Center 15th Addition lying northerly of the following described line commencing at the southeast corner of said Lot 1 thence on an assumed bearing of north 1 degree 27 minutes 59 seconds, east along the east line thereof a distance of 342.65 feet to an angle point in said east line thence north 5 degrees 30 minutes 16 seconds west along said east line a distance 92.74 feet to the actual point of beginning of the line to be described thence south 81 degrees 9 minutes 35 seconds west a distance 213.19 feet thence north 27 degrees 52 minutes 34 seconds west to northeasterly line of said Lot 1 and said line there terminating E. Change the guide plan classification from CO (Commercial Office) to C (Commercial) for properties located north of Highway 55 and east of South Shore Drive and legally described as: Southwesterly 199.38 feet of the northwesterly 135 feet of Block 4, Shiebe's Highland View Addition, including the adjacent one half of the vacated street, and Outlot A Holiday Addition, also Block 5, Schiebe's Highland View Addition including the adjacent half of vacant Francis Avenue and including that part of the adjacent half of vacated Florence Avenue lying northerly of the southeasterly extension of the northeasterly line of Lot 12, Block 2, Schiebe's Highland View Addition, except that part lying northeasterly of the following described line commencing at the intersection of the southeasterly extension of the southwesterly line of Block 5 and the center line of Francis Avenue thence northeasterly along said center line a distance of 225 feet to a point of the beginning of the line to be described Resolution 2001-287 (2001042) Page 3 thence deflecting left 90 degrees to the center line of Florence Avenue and said line there terminating, except the road, and Beginning at a point in the southwesterly line of Block 4, Schiebe's Highland View Addition, a distance of 135 feet southeasterly from the southwesterly corner thereof thence northeasterly parallel with the northwesterly line thereof 199.38 feet thence northwesterly parallel with the southwesterly line thereof to the northwesterly line thereof thence northeasterly to northwesterly to the corner thereof thence east to the northeast corner thereof thence south to the southeast corner thereof thence northwesterly to the beginning, including the adjacent half of streets vacated except the street, also Block 5, Schiebe's Highland View Addition, including the adjacent half of vacated Francis Avenue and including that part of the adjacent half of vacated Florence Avenue northerly of the southeasterly extension of the northeasterly line of Lot 12, Block 2, Schiebe's Highland View Addition lying northeasterly of the following described line commencing at the intersection of the southeasterly extension of the southwesterly line of Block 5 and the center line of Francis Avenue thence northeasterly along said center line a distance of 225 feet to the point of beginning of the line to be described thence deflecting left 90 degrees to the center line of Florence Avenue and said line there terminating including half of adjacent vacated streets, except streets; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the reclassification of the land use guiding for the properties described above, based on the following findings: 1. The reclassifications would create consistency between the land use guide plan and the zoning map as required by state law. 2. The reclassifications are consistent with existing use of the affected properties. 3. The reclassifications would not negatively impact any other Comprehensive Plan elements. 4. The reclassifications would not negatively affect the City fiscally. FURTHER, approval of the Land Use Guide Plan Amendment is contingent upon, and subject to, the required review and response by the Metropolitan Council. Adopted by the City Council on July 10, 2001.
