HomeMy WebLinkAboutCity Council Resolution 2001-266CITY OF PLYMOUTH RESOLUTION 2001-266 APPROVING LAND USE GUIDE PLAN AMENDMENT FOR HOM FURITURE FOR PROPERTY LOCATED AT 4150 BERKSHIRE LANE NORTH (2001037) WHEREAS, Hom Furniture has requested reclassification of the land use guiding from IP (Planned Industrial) to C (Commercial) for the 14.7 -acre parcel of land located at 4150 Berkshire Lane North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hom Furniture for reclassification of the land use guiding from IP (Planned Industrial) to C (Commercial) for property located at 4150 Berkshire Lane North, based on the following findings: 1. The site does not meet the location criteria for the current IP guiding for use as a distribution center due to its proximity to homes. The site meets the location criteria for C guiding. 2. The current IP guiding and related distribution center use of the site is not compatible with the nearby residential area. Reguiding the site to C would provide a use and transition that could be compatible with the nearby residential area. 3. The market demands for this site support a re-examination of the guiding. The proposed reguiding would help to provide for a reasonable use of this particular site. 4. There are very few, if any, remaining locations in the community that could accommodate the proposed use without reguiding. Resolution 2001-266 (2001037) Page 2 of 2 5. The proposed use would help to diversify the City's economic base and would provide goods that are not presently available in the City. 6. Reguiding of this 14.7 -acre site would not adversely impact either the industrial or commercial land supply. 7. The proposal would not result in negative impacts on traffic or other comprehensive plan elements. 8. The proposal would not result in negative fiscal impacts to the City. FURTHER, approval of the land use guide plan amendment is contingent upon, and subject to, the required review and response by the Metropolitan Council. ADOPTED by the City Council on June 26, 2001.
