RESOLUTION 2001-264
APPROVING A SITE PLAN, CONDITIONAL USE PERMITS, INTERIM USE
PERMIT, AND VARIANCES FOR JPI APARTMENT DEVELOPMENT, LP FOR
PROPERTY LOCATED NORTHEAST OF BASS LAKE ROAD AND QUINWOOD
LANE (2001040)
WHEREAS, JPI Apartment Development, LP has requested approval of a site plan, two
conditional use permits, interim use permit, and three variances for a 301 -unit apartment
development located on property legally described as follows:
The Northwest quarter of the Northwest quarter, Section 2, Township 118, Range
22, West of the 5"' Principal Meridian, according to the United States Government
Survey thereof and situated in Hennepin County, Minnesota, except that portion
thereof lying Westerly and Southerly of the center line of County State Aid
Highway No. 10 as platted in the recorded plat of Hennepin County State Aid
Highway No. 10, Plat 8, except that portion thereof platted as Maple Grove
Center Second Addition, and except that portion thereof platted as Bass Lake
Estates Third Addition.
DESCRIBED BY METES AND BOUNDS
That part of the Northwest Quarter of the Northwest Quarter of Section 2,
Township 118, Range 22, Hennepin County, Minnesota described as follows:
Beginning at northeast corner of said Northwest Quarter of the Northwest
Quarter; thence on an assumed bearing of South 0 degrees 04 minutes 37 seconds
East, along the east line of said Northwest Quarter of the Northwest Quarter a
distance of 596.00 feet to the centerline of Northwest Boulevard as described in
highway easement Document No. 5939150; thence South 55 degrees 03 minutes

50 seconds West along said centerline of Northwest Boulevard as described in
Document No. 5939150 a distance of 834.85 feet to the intersection of the north
right-of-way line of Bass Lake Road as defined in Hennepin County State Aid
Highway No. 10, Plat 8 (H.C.S.A.H. No. 10, Plat 8); thence easterly 462.84 feet
along a nontangential curve and along said northerly right-of-way line of said
H.C.S.A.H. No. 10, Plat 8, said curve is concave to the northeast, having a radius
of 685.43 feet and a central angle of 38 degrees 41 minutes 20 seconds, the chord
bears South 68 degrees 15 minutes 42 seconds East 454.09 feet; thence South 87
degrees 36 minutes 22 seconds East along said northerly right-of-way line a
distance of 128.59 feet; thence easterly 135.78 feet along a tangential curve and
along said northerly right-of-way line, said curve is concave to the south, having a
radius of 1159.66 feet and a central angle of 6 degrees 42 minutes 30 seconds to
the intersection of the east line of said Northwest Quarter of the Northwest
Quarter; thence South 0 degrees 04 minutes 37 seconds East not tangent to last
described curve, and along said east line, a distance of 33.44 feet to the centerline
of said H.C.S.A.H. No. 10, Plat 8; thence westerly 137.25 feet along a
nontangential curve and along said centerline, said curve is concave southerly,
having a radius of 11266.66 feet and a central angle of 6 degrees 58 minutes 47
seconds, the chord bears North 84 degrees 07 minutes 02 seconds West for a
distance of 137.16 feet; thence North 87 degrees 36 minutes 22 seconds West
tangent to last described curve and along said centerline, a distance of 128.59 feet;
thence westerly and northwesterly 713.06 feet along a tangential curve and along
said centerline, said curve is concave to the northeast, having a radius of 718.43
feet and a central angle of 56 degrees 52 minutes 02 seconds; thence North 30
degrees 44 minutes 20 seconds West tangent to last described curve and along said
centerline a distance of 391.03 feet; thence northwesterly 130.52 feet along a
tangential curve and along said centerline, said curve is concave to the southwest,
having a radius of 726.14 feet and a central angle of 10 degrees 17 minutes 54
seconds, to the intersection of the southwesterly extension of the southeasterly
right-of-way line of Quinwood Lane; thence North 45 degrees 47 minutes 08
seconds East, not tangent to last described curve, and along said right-of-way
extension and along said right-of-way line a distance of 235.80 feet; thence
northeasterly and northerly 225.11 feet along a tangential curve and along said
right-of-way line, said curve is concave to the northwest, having a radius of 278.12
and a central angle of 46 degrees 22 minutes 33 seconds; thence North 0 degrees
35 minutes 25 seconds West tangent to last described curve and along said right-
of-way line a distance of 118.09 feet to the southwest corner of Outlot B, Hickory
Ridge Center, according to the recorded plat and to the north line of said
Northwest Quarter of the Northwest Quarter; thence South 89 degrees 53 minutes
03 seconds East along said North line of the Northwest Quarter of the Northwest
Quarter and along the south line of the recorded subdivision plats of Hickory
Ridge Center, Gass Hickory Ridge and Hickory Ridge Third Addition a distance of
874.99 feet to the point of beginning.

WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by JPI Apartment Development, LP for a site plan, conditional use permits,
interim use permit, and variances for property located northeast of Bass Lake Road and
Quinwood Lane, subject to the following conditions:
1. A site plan is approved for a 301 -unit apartment development, in accordance with the
application and plans received by the City on May 15, 2001, except as amended by this
resolution.
2. This approval is contingent upon prior City Council approval of the Wetland
Replacement Plan for the project.
3. A conditional use permit is approved to allow more than one principal building on a
lot, with the finding that all the applicable general standards are met.
4. A conditional use permit is approved to allow increased building heights of 38 feet for
Building 2 and Building 5, and 43.25 feet for Buildings 3, 4, and 6, with the finding
that 1) the additional setback required for the proposed height would be provided, 2)
the building would not limit solar access to neighboring properties, and 3) the
applicable general standards are met.
5. An interim use permit for reduced parking is approved to allow installation of 689
parking spaces rather than 753 parking spaces, with the finding that all applicable
interim use permit standards are met. The City may terminate the interim use permit if
a parking shortage is observed on the site. In such case, the applicant would be
required to constrict additional parking spaces on the site.
6. A setback variance is approved to allow a parking setback of 25 feet for eight parking
spaces in the northern portion of the site along Quinwood Lane, where 30 feet is
specified, with the finding that all applicable variance standards are met.
7. A fence height variance is approved to allow a fence height of six feet along
Quinwood Lane, where three feet is the maximum fence height specified, with the
finding that all applicable variance standards are met.
8. A sign variance is approved to allow an area identification sign that is not located near
the entrance to the site and that does not meet the ten -foot setback requirement, with
the finding that all applicable variance standards are met.

9. This resolution approves a variance to the Fire Code requirement for fire lanes within
50 feet of all sides of the buildings within this development, subject to the conditions
listed in the Fire Inspector's Memo dated June 15, 2001, attached hereto and hereby
made a part hereof.
10. This approval is contingent upon City Council approval of the final plat, and no
building permits shall be issued until the final plat is recorded.
11. All waste containers shall be stored within the building.
12. The developer shall constrict a five-foot wide concrete sidewalk along the east side of
Quinwood Lane. The applicant shall also provide a ten -foot wide trail easement along
Quinwood Lane, Bass Lake Road, and Northwest Boulevard.
13. Prior to issuance of building permits, wetland buffer monumentation shall be installed,
consistent with Section 21670.07 of the Zoning Ordinance.
14. Prior to issuance of building permits, the applicant shall enter into a pond maintenance
agreement with the City for maintenance of the water quality ponds.
15. Standard Conditions:
A. Compliance with the City Engineer's Memorandums.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new strictures on sites adjacent to, or containing any open storm water drainage
facility.
C. Compliance with the tree preservation regulations.
D. Prior to issuance of building permits, submission of the required Financial
Guarantee and Site Performance Agreement for completion of site improvements
within twelve months of the date of this Resolution.
E. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
F. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes,
fire lanes, and fire lane signage.
G. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
H. The City requires reproducible mylar prints of the sanitary sewer, water service,
and storm sewer As-builts prior to releasing the financial guarantee.
L Payment of park dedication fees -in -lieu of land dedication according to the
dedication policy in effect at the time of filing the Final Plat with Hennepin County.
J. Compliance with regulations regarding handicapped parking spaces and access.
