HomeMy WebLinkAboutCity Council Resolution 2001-248CITY OF PLYMOUTH RESOLUTION 2001-248 APPROVING SITE PLAN AND A FIRE LANE VARIANCE FOR EDINA DEVELOPMENT CORPORATION FOR A 98 -UNIT TOWNHOUSE DEVELOPMENT LOCATED WEST OF VICKSBURG LANE AND NORTH OF SCHMIDT LAKE ROAD (20183) WHEREAS, Edina Development Corporation has requested approval of a site plan and a fire lane variance to allow constriction of a 98 -unit townhouse development on property legally described as follows: Outlot K, Nanterre, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Edina Development Corporation for a site plan and fire lane variance for a 98 -unit townhouse development located west of Vicksburg Lane and north of Schmidt Lake Road, subject to the following findings and conditions: 1. A site plan is approved to allow constriction of an 98 -unit townhouse development, in accordance with the plans and application received by the City on April 2, 2001, April 3, 2001 and May 2, 2001, except as amended by this resolution. 2. A fire lane variance is approved to allow the constriction of the townhouse units without fire lanes around the entire strictures subject to the following conditions: a. All buildings shall be protected by a City approved automatic fire alarm system throughout the buildings. b. Fire hydrants shall be located in approved locations throughout the development. c. The fire hydrant water main system shall be looped as shown on the plans. d. Fire flow calculations shall be submitted and approved prior to issuance of any permits. Resolution 2001-248 Site Plan (20183) Page 2 e. A secondary access road is required to the westerly proposed street. 3. Approval of the site plan is contingent upon City approval of the rezoning of the site to RMF -2 (Residential Multiple Family 2) and approval of the final plat. 4. Approval of this site plan is contingent on the project's compliance with the findings of the hydraulic and hydrologic study. 5. Approval of this site plan is contingent on the completion of the spring field check and confirmation of the boundaries as shown in the wetland delineation. 6. The applicant shall receive the necessary permits from Hennepin County, the DNR, MnDOT, the Watershed Management Districts, Army Corps of Engineers and MnPCA prior to beginning grading. 7. Prior to recording final plat or the issuance of any building permits, the applicant shall pay park dedication fees in accordance with the Dedication Policy in effect at the time of final plat recording, with credit for the dedication of the trail outlots. 8. Prior to the issuance of any permits for the project, a revised landscape plan shall be submitted to the City that shows the location, size and specie of each tree proposed. 9. Prior to the issuance of any building permits, the applicant shall provide plans showing all signage proposed for the property. The plans and all signage shall comply with the sign regulations of the Zoning Ordinance and be similar to the signs in the Nanterre development using compatible materials 10. No building permits shall be issued until the final plat is recorded. 11. The applicant shall be responsible for constricting the trail in the trail outlot across the entire project. Financial guarantees for the completion of this item shall be included in the Site Improvements and Performance Agreement (SIPA). 12. The applicant is strongly encouraged to continue working with staff to explore various options to make a portion of the dwelling units affordable. 13. All the living trees along Schmidt Lake Road shall be retained, but may be moved and replanted in close proximity to accommodate trail and road constriction. 14. Standard Conditions: a. Compliance with the City Engineer's Memorandum. Resolution 2001-248 Site Plan (20183) Page 3 b. Prior to the issuance of a building permit, the applicant shall submit of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution. c. Removal of all hazardous trees from the property at the owner's expense. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance. g. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, post - indicator valves, 45 degree turn radius on private drives, fire department connections, and fire lane signage. h. Prior to issuance of utility or building permits, submission and approval of fire flow calculations. i. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. ADOPTED by the City Council on June 12, 2001.
