HomeMy WebLinkAboutCity Council Resolution 2001-227CITY OF PLYMOUTH RESOLUTION 2001-227 APPROVING CONDITIONAL USE PERMIT FOR NORCOSTCO FOR PROPERTY LOCATED AT 815 HIGHWAY 169 NORTH (2001030) WHEREAS, Norcostco has requested approval of a conditional use permit to allow up to 18 percent of the gross floor area for accessory retail use in the industrially -zoned building located on property legally described as follows: Lots 21 and 22 Plymouth Gardens, except that East 167 feet thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Norcostco for a conditional use permit to allow 18 percent accessory retail use in the industrially -zoned building located at 815 Highway 169 North, subject to the following conditions: 1. The conditional use permit allows up to 2,702 square feet (18 percent) for accessory retail use at the 15,084 square -foot building located at 815 Highway 169 North, in accordance with the application and plans received by the City on March 30, 2001 and April 19, 2001, except as amended by this resolution. 2. The appropriate building permits must be obtained by the applicant prior to constriction of the retail space within this building. 3. Prior to issuance of building permits for the principal stricture, the shed located on the west side of the property shall be removed or relocated to a location in conformance with the zoning ordinance. Prior to the issuance of building permits, the applicant shall submit revised plans showing one parking space converted into a handicapped -accessible (van) stall as well as one additional parking space. 5. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
