RESOLUTION NO. 2001-209
REQUEST FOR PAYMENT NO. 3 AND FINAL
TROY LANE SANITARY SEWER
NORTH OF COUNTY ROAD 6
CITY PROJECT NO. 7018
WHEREAS, the City of Plymouth as owner and Penn Contracting, Inc. as contractor,
have entered into an agreement for the Troy Lane Sanitary Sewer Project, North of
County Road 6, City Project No. 7018, said agreement being dated December 14, 1999;
and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $149,329.10. There were no
change orders on the project and the value of the work to date is
$138,833.35 and is herewith approved. This project does not exceed the
contract amount.
2. That the work performed by the contractor for Troy Lane Sanitary Sewer
Project, North of County Road 6 and certified to the Council by the
engineer as acceptable, being the same, is hereby released from the contract
except as to the conditions of the performance bond, any and all legal
rights of the owner, required guarantees and correction of faulty work after
final payment.
3. Request for Payment No. 3 and Final in the amount of $9,791.67 to Penn
Contracting, Inc. for the Troy Lane Sanitary Sewer Project, North of
County Road 6, is hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
