HomeMy WebLinkAboutCity Council Resolution 2001-150CITY OF PLYMOUTH RESOLUTION 2001-150 APPROVING A CONDITIONAL USE PERMIT FOR ASCENSION LUTHERAN PRESCHOOL AT ASCENSION EVANGELICAL LUTHERAN CHURCH AT 15870 46TH AVENUE NORTH (2001013) WHEREAS, Steve Merten has requested approval of a conditional use permit to allow operation of a pre-school in the existing building on property legally described as follows: Lot 1, Block 1, Amhurst 6"' Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Steve Merten for a conditional use permit for property located at 15870 46"' Avenue North, subject to the following conditions: 1. A site plan amendment and conditional use permit for a pre-school facility at Ascension Evangelical Lutheran Church is approved, in accordance with the application and plans received by the City on February 9, 2001, except as amended by this resolution. 2. A copy of the State of Minnesota Department of Human Services license for this property shall be submitted to the City. 3. Separate building permits are required for any interior building modifications. 4. Signage shall comply with the sign regulations of the Zoning Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 2001-150 (2001013) Page 2 of 2 6. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 7. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
