HomeMy WebLinkAboutCity Council Resolution 2001-118CITY OF PLYMOUTH RESOLUTION NO. 2001-118 AUTHORIZING THE TERMINATION OF THE POND MAINTENANCE AGREEMENT FOR PLYMOUTH TECHNOLOGY PARK WHEREAS, a petition was received to terminate a pond maintenance agreement; and WHEREAS, said petition was signed by the majority owner of the land abutting the NL RP Pond covered by the maintenance agreement; and WHEREAS, the pond was relocated and enlarged to accommodate the constriction of the Cheshire Lane Bridge; and WHEREAS, drainage from Cheshire Lane and Cheshire Lane Bridge will be directed to this pond for water quality treatment; and WHEREAS, pursuant to paragraph 5 of the maintenance agreement the owner is requesting the City to provide the maintenance for the pond since the pond was relocated and the pond is providing treatment for Cheshire Lane drainage; and WHEREAS, it was determined by the City Council that the maintenance agreement is no longer needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the pond maintenance agreement recorded as document number 2664105 for all of Plymouth Technology Park be terminated: C Documents and Settnig, infieeseALocal Settuig, TeupCCR 2001-118__a3-5CCR 2001-118 doe Resolution No. 2001-118 Page 2 of 2 Further, that the City is responsible for the maintenance of the treatment pond.
