HomeMy WebLinkAboutCity Council Resolution 2001-105CITY OF PLYMOUTH RESOLUTION 2001-105 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT, AND VARIANCE FOR STATION 19 ARCHITECTS, INC, FOR MOUNT OLIVET LUTHERAN CHURCH LOCATED AT 12235 OLD ROCKFORD ROAD (20188) WHEREAS, Station 19 Architects, Inc. has requested approval of a site plan amendment, conditional use permit amendment, and variance for property legally described as follows: That part of the East half of the Southwest quarter of Section 14, Township 118, Range 22, described as follows: Beginning at the Northwest corner of said tract, thence running East along the North line of said tract 300 feet: thence running South parallel to the west line of said tract 500 feet: thence West parallel to the North line of said tract 300 feet to the west line of said tract: thence north along the west line of said tract 500 feet to the point of beginning. ALSO All that part of the east half of the Southwest quarter of said Section 14, Township 118, Range 22, described as follows: Commencing at a point on the north line of said East half of the Southwest quarter distant 300 feet East of the Northwest corner thereof: thence South parallel with the West line of said East half of the Southwest quarter a distance of 24.18 feet, more or less, to the centerline of Old Countv Road No. 9 (Old Rockford Road) as now laid out and traveled; thence continuing South along the last described course a distance of 250 feet to the actual point of beginning of the tract of land to be described, said point of beginning being the Southwest corner of that tract of land described in Book 2132 of Deeds, Page 533, In the Office of the County Recorder in and for said Hennepin County, Minnesota; thence East at right angles a distance of 180 feet: thence South Resolution 2001-105 File No. 20188 Page 2 parallel with the West line of said East half of the Southwest quarter a distance of 327.39 feet, more or less, to the intersection with a line drawn parallel with and 600 feet south of the north line of said East half of the Southwest quarter: thence West along the last described parallel line a distance of 480 feet to the West line of said East half of the Southwest quarter; thence north along said West line a distance of 100 feet: thence East parallel with said North line of the East half of the Southwest quarter a distance of 300 feet to the intersection with a line drawn South from the actual point of beginning parallel with the West line of said East half of the Southwest quarter of Section 14; thence North along the last described parallel line to the actual point of beginning. Subject to the right-of-way of Old County Road No. 9 (Old Rockford Road). ALSO That part of the north 420.14 feet of the east 302.00 feet, as measured along the north and east lines, of the Northwest quarter of the Southwest quarter of Section 14, Township 118, Range 22, Hennepin County, Minnesota 1ving south of the centerline of Old County Road 9 (Rockford Road). WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by station 19 Architects, Inc. for a site plan amendment, conditional use permit amendment, and variance, subject to the following conditions: 1. A site plan amendment and conditional use permit amendment are approved for a 22,800 square foot building addition and a parking lot expansion in accordance with the plans received by the City on January 30, 2001, except as amended by this resolution. 2. This approval is contingent upon approval of a rezoning for a portion of the site from FRI) to RSF-1 and lot consolidation to combine the four parcels south of Old Rockford Road into one lot. 3. A variance is approved to allow a parking setback of 12 feet from the north (front) lot line, where 20 feet is the minimum parking setback specified by the Zoning Ordinance, based on the finding that: a. The requested 12 -foot setback would allow the expansion parking area to match up with the existing non -conforming parking lot setback on the eastern portion of the site. Maintaining a consistent parking setback from Old Rockford would improve safety and circulation of the parking lot because internal drive aisles would line up with each other. b. A typical boulevard (i.e., the space between street curb line and private property line) is roughhv 10 feet along local streets. In this particular case, however, the boulevard is Resolution 2001-105 File No. 20188 Page 3 rougl*v 18 -feet Nvide. Combining this Nvider than typical boulevard with the proposed 12 - foot setback would maintain a rougl*v 30 -foot separation between the actual roadway the parking lot, therefore, the reduced setback would not be distinguishable from the road. c. The variance would alloy a reasonable use of land and would not be detrimental to the public welfare or injurious to other land in the neighborhood. The proposed setback would not impair an adequate supple of light and air to adjacent property, endanger public safety, increase congestion of the public streets, increase the danger of fire or substantially diminish property values in the neighborhood. d. The purpose of the variance is not based upon a desire to increase the value or income potential of the parcel of land: but rather, to expand the existing parking lot to help eliminate a current parking shortage. &4Building permits are required prior to commencement of the project. .- - - Formatted: Bullets and Numbering 5. Prior to issuance of building permits, the City must receive proof of a private easement agreement between the church and Hennepin Parks for the discharge of storm -water runoff onto the park property. 6. This resolution approves a variance to the Fire Code requirement for a fire lane Nvithin 50 feet of the south and Nvest sides of the building, subject to the conditions listed in the Fire Inspector's February 14, 2001 Memorandum, attached hereto. 2-f-.-7. Comphance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. g-.e.An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per Cite Policy. j -f This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06 and 21045.09 of the Zoning Ordinance.
