HomeMy WebLinkAboutCity Council Resolution 2001-103CITY OF PLYMOUTH RESOLUTION 2001-103 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR ACE MINI STORAGE LLC TO ALLOW CONSTRUCTION OF A SECOND MINI -STORAGE BUILDING AT 5525 HIGHWAY 169 (20176) WHEREAS, Ace Mini Storage LLC has requested approval of a site plan and conditional use permit to allow constriction of a 33,660 -square foot building on property legally described as follows: That part of the southeast quarter of the southeast quarter, Section 1, Township 118, Range 22, described as follows: Beginning at a point on the east line of the southeast quarter of said Section 1 distant 1380.50 feet south from the northeast corner of said southeast quarter; thence west, at a right angle to said east line 415.00 feet; thence south, at a right angle, to the north line of the south 990.00 feet of said southeast quarter; thence east along said north line to the east line of said southeast quarter; thence north along said east line to the point of beginning; except that part lying east of the westerly line of the plat of Hennepin County State Aid Highway No. 18, Plat 32. Subject to a permanent easement for drainage purposes in favor of the County of Hennepin over that part of Par 1 lying within 12.5 feet on each side of the following described line: Beginning at a point on the east line of the southeast quarter of Section 1, Township 118, Range 22, distant 1615.50 feet southerly from the northeast corner thereof, thence westerly at right angles to said east line a distance of 208.00 feet and there terminating, County Recorder Document No. 3864363; Subject to a permanent easement for drainage purposes over the easterly 10 feet of Parcel 1, including covenants and restrictions as to the use of the easement area, in favor of County of Hennepin as contained in County Recorder Document No. 4022990; Subject to a snow fence easement in favor of County of Hennepin as contained in County Recorder Document No. 4022990; Resolution 2001-103 (20176) Page 2 of 3 Subject to a limitation on the right of access from Par 1 to Hennepin County State Aid Highway No. 18, as contained in County Recorder Document No. 3864363. And That part of the north 170.00 feet of the south 990.00 feet of the east 796.00 feet of the southeast quadrant of the southwest quarter, Section 1, Township 118, Range 22, lying west of the westerly line of the plat of Hennepin County State Aid Highway No. 18, Plat 32. Subject to a permanent easement for drainage purposes over the easterly 10 feet of Par 2, including covenants and restrictions as to the use of the easement area, in favor of the County of Hennepin as contained in County Recorder Document Nos. 4056822 and 4056823; Subject to a snow fence easement over Par 2 in favor of the County of Hennepin as contained in County Recorder Document Nos. 4056822 and 4056823; Subject to a limitation on the right of access from Par 2 to Hennepin County State Aid Highway No. 18, as contained in County Recorder Document No. 3871723 and 3871724. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan and conditional use permit for a mini -storage building at 5525 Highway, subject to the following conditions: 1. A site plan and conditional use permit are approved to allow constriction of a 33,660 -square foot building, in accordance with the plans received by the City on February 1, 2001, except as amended by this resolution. 2. This approval includes a conditional use permit to allow a second principal stricture on the lot at 5525 Highway 169. 3. Prior to issuance of building permits, the applicant shall submit a revised landscape plan showing: 1) replacement of the trees along the north and west lot lines with shrubbery pursuant to the design standards for a rain garden, and 2) additional trees in the front (east) yard area to provide screening for the exterior mechanical areas located north and south of the building. 4. Prior to issuance of the building permit, the applicant shall submit a revised lighting plan indicating compliance with the lighting regulations of the Zoning Ordinance. 5. Standard Conditions: Resolution 2001-103 (20176) Page 3 of 3 a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance. f. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, post - indicator valves, fire department connections, fire lanes, and fire lane signage. g. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. ADOPTED by the City Council on March 20, 2001.
