HomeMy WebLinkAboutCity Council Resolution 2001-096CITY OF PLYMOUTH RESOLUTION NO. 2001-096 AUTHORIZATION OF SETTLEMENT AND PAYMENT OF WORKERS' COMPENSATION AND EMPLOYMENT RELATED CLAIM WHEREAS, the City of Plymouth has been authorized to self -insure its Workers' Compensation exposure under the Laws of the State of Minnesota from April 1, 1980 to the present. The City contracts with Berkley Administrators to administer its self-insured program and authorizes Berkley Administrators to pay statutory Workers' Compensation obligations from a Workers' Compensation Trust Account established by the City; and WHEREAS, a Plymouth employee was injured during the course of employment. The employee continued to treat with various physicians and claims and contends that another injury was sustained during the course of employment. The City tried and was unable to provide suitable work assignments that would fit the restrictions. WHEREAS, Berkley Administrators and Counsel negotiated a fiill and complete settlement of all Workers' Compensation and Employment Related Claims on behalf of the City of Plymouth in the amount of $80,500. Therefore, we request authorization to deposit $80,500 in the Workers' Compensation Trust Account and provide fiends for Berkley Administrators to conclude the settlement. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the City of Plymouth authorizes the payment of $80,500 from the Risk Management Fund to settle the Workers' Compensation and Employment Related Claim addressed in the Risk Management Coordinator's memorandum of February 20, 2001. Adopted by the City Council on February 27, 2001.
