APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED AT 3 13 5,
3225 AND 3235 FERNBROOK LANE NORTH (20136)
WIIEREAS, DaVern II has requested reclassification of the zoning from FRD (Future Restricted
Development) to O -R (Office/Residential) for 4.4acres of land located at 3135, 3225 and 3235
Fernbrook Lane, legally described as follows:
The east 16 rods of the north 40 rods of the south five-eighths of the southeast quarter of the
northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota, except
the north 10 rods thereof.
And,
The east 16 rods of the north 10 rods of the south half of the north three-quarters of the southeast
quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County,
Minnesota.
And,
The south 110 feet of the east 175 feet of the north three-eighths of the southeast quarter of the
northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota.
WI-1EREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WIIEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD
(Future Restricted Development) to O -R (Office/Residential).

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from FRD (Future Restricted Development) to O -R
(Office/Residential) for 4.4 acres of land located at 3135, 3225 and 3235 Fernbrook Lane, based
on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and
plans.
2. The proposed development meets the standards of the O -R (Office/Residential) zoning
district.
3. There is adequate infrastructure available to support the O -R zoning and office development
proposed for this site.
ADOPTED by the City Council on February 27, 2001.
