HomeMy WebLinkAboutCity Council Resolution 2001-092CITY OF PLYMOUTH RESOLUTION 2001-092 APPROVING PRELIMINARY AND FINAL PLAT FOR DAVERN II FOR PROPERTY LOCATED AT 3 13 5, 3225 AND 3235 FERNBROOK LANE (20136) WHEREAS, DaVern II has requested approval of a preliminary and final plat for property legally described as follows; The east 16 rods of the north 40 rods of the south five-eighths of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota, except the north 10 rods thereof. And, The east 16 rods of the north 10 rods of the south half of the north three-quarters of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota. And, The south 110 feet of the east 175 feet of the north three-eighths of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DaVern II for a preliminary and final plat, subject to the following conditions: Resolution No. 2001-092 File No. 20136 Page 2 of 2 1. A preliminary and final plat is approved for the creation of Lots 1-19, Block 1, Fernbrook Town Office Park, according to the plans and application received by the City on September 26, 2000 and revisions received on January 26, 2001 and January 29, 2001, except as amended by this resolution. 2. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. 3. The applicant must comply with the City Engineer's Memorandum. 4. The applicant shall remove all hazardous trees from the property at the owner's expense. 5. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. 6. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
