HomeMy WebLinkAboutCity Council Resolution 2001-091CITY OF PLYMOUTH RESOLUTION 2001-091 APPROVING SITE PLAN FOR A 47,040 -SQUARE FOOT OFFICE DEVELOPMENT AND AN INTERIM USE PERMIT TO REDUCE THE NUMBER OF REQUIRED PARKING STALLS FOR FERNBROOK TOWN OFFICE PARK AT 3135, 3225 AND 3235 FERNBROOK LANE NORTH (20136) WHEREAS, DaVern II has requested approval of a site plan to allow constriction of six three - unit office buildings totaling 47,040 square feet and an interim use permit to reduce the number of required parking stalls on property legally described as follows: The east 16 rods of the north 40 rods of the south five-eighths of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota, except the north 10 rods thereof. And, The east 16 rods of the north 10 rods of the south half of the north three-quarters of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota. And, The south 110 feet of the east 175 feet of the north three-eighths of the southeast quarter of the northeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; GZ�9 Wiwow, iI8ZQilea (20136) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan for an office development and an interim use permit to reduce the number of required parking stalls on property located at 3 13 5, 3225 and 3235 Fernbrook Lane North, subject to the following conditions: 1. A site plan is approved to allow constriction of an approximately 47,040 -square foot office complex, in accordance with the plans received by the City on January 26, 2001 and January 29, 2001, except as amended by this resolution. 2. The interim use permit is to permit a reduction in the number of required parking stalls from 170 to 138, according to the plans received by the City on January 26, 2001 and January 29, 2001, except as amended by this resolution. 3. Approval of the site plan and interim use permit is contingent upon the City Council approval of the rezoning from FRD (Future Restricted Development) to O -R (Office/Residential) and approval of the preliminary plat. 4. Approval of the interim use permit is based on the condition that no medical office uses, which generate a higher parking demand than professional office uses, shall be permitted. 5. The Interim Use Permit shall terminate if any of the following events occur: a. City staff documents a parking problem associated with inadequate parking. b. The floor area of the building is increased in size. 6. If City staff documents a parking problem, the developer would be required to create additional stalls by converting some of the standard stalls to compact stalls and providing a Traffic Demand Management (TDM) plan for City review and approval. 7. Approval of a fire lane variance, subject to the following conditions: a. Protect each building with a City -approved fire sprinkler system. b. Eliminate the parking space at the location of the middle fire hydrant of the three on- site fire hydrants. c. Locate the Fire Department connection for the building fire sprinkler system on each building so as to ensure unobstructed fire access to the Fire Department connection. d. Provide a paved, four -foot wide access walk from the east side sidewalk to the west side sidewalk in between each of the buildings. GZ�9 Wiwow, iI8ZQilea (20136) Page 3 8. The developer must submit a copy of the association documents for staff review. The association documents shall be filed with the final plat. 9. The site plan shall be revised to incorporate all of the affected property. The northern portion of the property is not shown on the site plan. 10. The existing and proposed property lines must be shown on all plan sheets. Revise the plans accordingly. 11. Lighting for this development shall be in compliance with the Section 21105 of the Zoning Ordinance. 12. The site must be staked and fenced for tree preservation according to the approved tree preservation plan. The tree preservation fencing must be inspected and verified by the City Forester prior to issuance of grading permits. 13. A minimum of 25 percent of the required trees (12 trees) shall be coniferous trees. The landscaping plan shall be revised accordingly. 14. The applicant shall submit lighting details for staff review. The fixtures must comply with the cutoff requirements in Section 21105.06 of the Zoning Ordinance. 15. All waste and waste containers shall be stored within the enclosure stricture, and no outside storage is permitted. 16. The developer shall not use the existing Fernbrook Lane trail for storage or access to the site. The developer shall be responsible for any damage done to the trail during constriction. 17. Building permits are required prior to installation of signage. Signage for this development shall be in compliance with the sign ordinance in effect at the time of permit issuance. 18. All signage must be located on the subject property in compliance with setback requirements. Revise the plans to remove the sign proposed in the right-of-way near the southern entrance. 19. Building permits are required prior to beginning constriction. 20. No building permits shall be issued until the final plat is recorded at Hennepin County. 21. The applicant must comply with the conditions in the City Engineer's Memorandum. 22. No variances are granted or implied. GZ�9 Wiwow, iI8ZQilea (20136) Page 4 23. Standard Conditions: a. Submission of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. b. Removal of all hazardous trees from the property at the owner's expense. c. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. d. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, post - indicator valves, fire department connections, fire lanes, and fire lane signage. e. Submission of fire flow calculations prior to issuance of building permits. f. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. h. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. i. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21020.02 of the Zoning Ordinance.
