AUTHORIZATION OF CONSENT TO TERMINATION OF DECLARATION FOR
FOXGLOVE PROPERTIES (92036)
WHEREAS, In 1992, the City of Plymouth and Foxglove Properties have entered into a Site
Improvement Performance Agreement; and
WHEREAS, A financial guarantee for the Site Improvement Performance Agreement was in the
form of a Declaration of Covenants; and
WHEREAS, On October 7, 1993, Upshre-Smith Laboratories Inc. received a Certificate of
Occupancy for their building addition, which automatically made the declaration null and void.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUHTH, MINNESOTA: That the Mayor and City Manager are authorized to execute
the Consent to Termination of Declaration for Foxglove Properties.
ADOPTED by the City Council this 27"' day of February, 2001.
