RESOLUTION NO. 2001-076
AUTHORIZING DISPOSITION OF REAL PROPERTY
XENIUM LANE SOUTH OF COUNTY ROAD 47
WHEREAS, a petition was received for disposition of a portion of property owned by the
City which was formerly used for street right-of-way adjacent to I-494 southerly of County
Road 47; and
WHEREAS, the Planning Commission has reviewed the property and found that its
ownership is no longer necessary in accordance with the City's Comprehensive Plan; and
WHEREAS, the property for which this right-of-way provided access is being developed as
"The Reserve" development; and
WHEREAS, in accordance with State Statute and City Charter a public hearing was
scheduled and held by the City Council on February 13, 2001; and
WHEREAS, all adjacent property owners were notified of the proposed disposition of this
property.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following parcel of land is authorized for
conveyance to the developer of "The Reserve" in exchange for an equal area of land which
is part of "The Reserve" development to be purchased by the City for a water tower site.
Payment for the water tower site will be based on the net difference between the total
amount being purchased and the amount being conveyed to the developer.
That part of the South 30 feet of the East 700 feet of the North Half of the
Southeast Quarter of the Southwest Quarter and that part of the North 30 feet
of the East 700 feet of the South Half of the Southeast Quarter of the
Southwest Quarter, all in Section 3, Township 118, Range 22, Hennepin
County, Minnesota, which lies westerly of a line drawn parallel with and 40
feet westerly of the westerly right of way line of Interstate Highway 494.
FURTHER, that the Mayor and City Manager are authorized to execute the
necessary deeds to convey the property.
