HomeMy WebLinkAboutCity Council Resolution 2001-072CITY OF PLYMOUTH RESOLUTION NO. 2001-072 AMENDING VACATION RESOLUTION 84-259, (part of Juneau Lane) ADOPTED BY CITY COUNCIL ON MAY 7, 1984 and RECORDED AT HENNEPIN COUNTY AS DOCUMENT NUMBERS 2311922 (Torrens) and 6198516 (Abstract) WHEREAS, a petition was received in 1984 to vacate a portion of Juneau Lane, known as Minerva Road within Suburbandale on Parker Lake plat; and WHEREAS, said resolution 84-259 was adopted by the City council and recorded at Hennepin County on November 3, 1992 under Torrens document No. 2311922 and was also recorded, on December 10, 1993 under Abstract document No. 6198516; and WHEREAS, the Examiner of Titles office at Hennepin County has determined that the vacation description in resolution 84-259 is ambiguous and needs to be clarified as to the intent of what is to be vacated; and WHEREAS, it is in the public interest to accurately describe the vacated street right of way as intended by the petitioner; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of Juneau Lane (formerly Minerva Road) be vacated as a public roadway: That part of Juneau Lane, dedicated as Minerva Road in the plat of Suburbandale on Parker Lake, lying northerly of the easterly extension of the south line of Lot 11, Block 2, said plat, and southerly of a line parallel with and distant 10 feet southerly, as measured at right angles, from the north line of Lot 10, Block 4, said plat, extended westerly across said Juneau Lane. C Documents and Settnig, mfieeseALocal Setting, TempCCR 2001-0-2__ 4329 CCR 2001-0-2 doe Resolution No. 2001-072 Page 2 of 2 FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
