RESOLUTION 2001-059
APPROVING VARIANCE FOR A FOUR -FOOT HIGH FENCE IN THE FRONT YARD FOR
DARIN AND KAMI AHO ON PROPERTY LOCATED AT 4605 COTTONWOOD LANE
NORTH (20180)
WHEREAS, an application has been filed by Darin and Kami Aho, which requests approval of a
variance for a four -foot fence in the front yard where the Zoning Ordinance permits a three-foot
fence. The variance would allow a fence on the front property line of property legally described
as follows:
That Lot 8, Block 1, Deerwood Estates Plat 4.
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Darin
and Kami Aho for a variance to allow a four -foot high fence in the front yard for property located
at 4605 Cottonwood Lane north, subject to the following conditions:
1. This resolution approves a variance for a four -foot fence in the front yard where the Zoning
Ordinance permits a three-foot fence, in accordance with the plans and application received by
the City on November 20, 2001, except as amended by this resolution.
2. The variance for the four -foot high fence is approved with the finding that the applicable
variance standards are met. Specifically:
a. The request is not based upon a desire to increase the value or income potential of the
property, but rather to reduce liability associated with the owner's large dog and a new
swing set.

b. The variance would not be detrimental to the public welfare or injurious to other land or
improvements in the neighborhood, because the fence would not obstruct the visibility of
motorists using the public streets.
c. Staff finds that the variance would not impair an adequate supply of light and air to
adjacent property, increase the congestion of public streets, increase the danger of fire, or
endanger the public safety. The fence would be aesthetically compatible with the
neighborhood.
3. The fence shall remain plastic coated chain link.
