HomeMy WebLinkAboutCity Council Resolution 2001-033CITY OF PLYMOUTH RESOLUTION 2001-033 APPROVING SIGN VARIANCE REQUEST FOR PARKERS LAKE BAPTIST CHURCH ON PROPERTY LOCATED AT 14720 COUNTY ROAD 6 (20186) WHEREAS, an application has been filed by Parkers Lake Baptist Church which requests approval of a sign variance to permit a nine -foot freestanding sign with a surface area of 41 square feet on property legally described as follows: Parcel 1: Lots 9 and 10, Block 1, "Raths Second Addition", according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County; and, Parcel 2: That part of Government Lot 2, Section 28, Township 118, Range 22 described as follow: Commencing at the intersection of a line drawn at right angles to the West line of said Government Lot 2 from a point thereon distant 694.27 feet South along said West line from the Northwest corner of said Government Lot 2 with the East line of said Government Lot 2, the point of beginning of the tract to be described, thence West along said right angle line to the intersection with a line drawn parallel with and 1020 feet East measured at right angles from the West line of said Government Lot 2; thence at a right angle South to the centerline of County Road No. 6; thence West along said centerline to its intersection with a line drawn parallel with and 820 feet East, measured at right angles from the west line of said Government Lot 2; thence south parallel with the west line of said Government Lot 2 to the southerly line of said Government Lot; thence easterly along said southerly line to the east line of said Government Lot 2; thence North along said East line to the point of beginning; except all that part thereof lying South of the centerline of Hennepin County State Aid Highway Number 6, Plat 5. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve Resolution No. 2001-033 Page 2 of 3 the request by Parker's Lake Baptist Church for a sign variance to a nine -foot freestanding sign with a surface area of 41 square feet to be located at 14720 County Road 6, subject to the following conditions: 1. This resolution approves a variance to permit a nine -foot freestanding sign with a surface area of 41 square feet to be located at 14720 County Road 6, in accordance with the plans and application received by the City on December 8, 2000, except as amended by this resolution. 2. The variance for a nine -foot freestanding sign with a surface area of 41 square feet to be located at 14720 County Road 6 is approved with the finding that the applicable variance standards are met. Specifically: a) A small sign meeting the ordinance requirements is difficult to see because of characteristics unique to the site. As part of the County Road 6 widening project the City built a retaining wall in front of the church. The retaining wall is six feet tall. The proposed sign is set ten feet back from the top of the retaining wall. This peculiar situation reduces visibility of the sign. b) The new sign is proposed to be larger due solely to compensate for topographical features unique to this property. c) The sign in not related to the property value in this variance application. d) The hardship is caused by the Zoning Ordinance and the widening of County Road 6. e) Approval of the sign variance will have no effect on the public welfare or be injurious to other land or improvements in the neighborhood. f) The proposed 41 -square foot sign would not impair an adequate supply of light and air to adjacent property or substantially increase the congestion of the public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood. g) The requested variance is the minimum action required to eliminate the hardship. The variance would allow the applicant to replace the existing sign with one that is larger. 3. The applicant must obtain a sign permit, prior to any replacement of the existing sign. Resolution No. 2001-033 Page 3 of 3 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 5. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
