WHEREAS, the Planning Commission has reviewed the study area at a duly called public hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the reclassification of the land use guiding from C (Commercial) to CO (Commercial Office) for property located in Study Area E-1, as shown on the attached map. Approval is based on the following findings: a. Changes in adjacent guiding and subsequent development have made retail commercial use of this property inappropriate, based on City requirements for setbacks, buffering and transitions. b. Residential use of this property is not appropriate, based on its physical separation from adjacent neighborhoods and impacts from traffic and traffic -noise. c. Commercial Office uses would complement the proposed commercial development on Peony Lane and Highway 55 and provide an appropriate transition between the retail commercial uses and the adjacent residential uses. d. The Commercial Office guiding would provide an opportunity for the property to be developed as a gateway to the City. e. The subject site meets the location criteria for CO guiding. FURTHER, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does retain the existing land use Resolution 2001-026 (20043) Page 2 classifications for the two southeastern parcels in Study Area E-1, as shown on the attached map, and conclude the land use study for this area. Approval is based on the following findings: 1. The City has completed a thorough study of Area E -I and finds that the existing guiding is appropriate for these parcels. 2. The property could be developed under the existing C (Commercial) land use designation and provide appropriate transitions and buffers to the adjacent land uses. FURTHER, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does amend the official Land Use Guide Plan map to remove the "Study Area E" designation.
