HomeMy WebLinkAboutCity Council Resolution 2002-592CITY OF PLYMOUTH RESOLUTION NO. 2002-592 AUTHORIZING THE VACATION OF A PERPETUAL SANITARY SEWER EASEMENT (PAULAS PLACE) WIffiREAS, a petition was received to vacate part of a perpetual sanitary sewer easement in Parcel 30- 118-22-14-0001; and WI-1EREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and VJ-1EREAS, a public hearing with respect to said vacation was scheduled for December 17, 2002 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WIffiREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 17, 2002; and WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WIffiREAS, the Council did hold a public hearing on December 17, 2002 to inform any and all interested parties relevant to the vacation of a perpetual sanitary sewer easement within Parcel 30-118- 22-14-0001; and WI-1EREAS, it was determined by the City Council that said easement was not needed for public purposes; Resolution No. 2002-592 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the portion of the perpetual sanitary sewer easement as described below be vacated: DESCRIPTION OF PERPETUAL SANITARY SEWER EASEMENT: A perpetual sanitary sewer easement lying within a 20 foot strip of land the centerline of which is described as follows: Commencing at the Southwest corner of Lot 1, Block 1, Snyder's Pine Ridge; thence Northerly along the Westerly line of said Lot 1, a distance of 125 feet to the point of beginning of the line to be described; thence Easterly, deflecting to the right 96°, a distance of 100 feet; thence Northeasterly, deflecting to the left 44° 22' 02", a distance of 81.34 feet; thence Northeasterly, deflecting to the left 19° 33' 25", a distance of 297.34 feet; thence Northerly, deflecting to the left 10° 02' 31 ", a distance of 205.88 feet; thence Northerly, deflecting to the left 23° 20' 14", a distance of 251.88 feet; thence Northeasterly, deflecting to the right 41° 29' 43", a distance of 471.88 feet to a point on the Southerly line of Lot 7, Block 4, Sunny Acres, distant 61.71 feet Westerly of the Southeast corner of said Lot 7 and there terminating. Also, a perpetual sanitary sewer easement over the East 185.0 feet of the North 30.0 feet of the above described property. DESCRIPTION OF PORTION OF PERPETUAL SANITARY SEWER EASEMENT TO BE VACATED: That portion that lies within the record plat of PAULAS PLACE and Northerly of the following described line: Beginning at a point on the Westerly line of Lot 11, Block 1 of said PAULAS PLACE, distant 283.62 feet Southeasterly, as measured along said Westerly line, from the Northwest corner of said Lot 11; thence North 88 degrees 13 minutes 02 seconds East, assuming that the North line of said Lot 11 bears North 88 degrees 20 minutes 44 seconds East, a distance of 232.77 feet and said line there terminating.
